An appeal under subsection 3 of section 19 of the Right to Information Act 2005 to curb the misinterpretation of provisions of Right to Information Act 2005 by bureaucrats of state of Uttar Pradesh as well as diluting its provisions to safeguard the corrupt activities of corrupt staffs of the various departments.

Claim -There is no rule of law in the government of Uttar Pradesh, we are being governed by sheer anarchy. No constitutional functionaries are protecting our constitutional rights. Think about the gravity of the situation that state public information officer arbitrarily denied the sought information and first appellate authority blindly upheld the denial of SPIO by falsely speculating the circulars in its favour. I have suspense in regard to eligibility of duo as such absurd and vague explanation itself proves incompetency.

Prayer-SPIO may be directed to provide the sought information and both are fit to take action under section 20 of the Right to Information Act 2005 as willfully encroached and infringed the provisions of August act.

With due respect, the appellant invites the kind attention of the revered learned Chief  Information Commissioner of Govt. of Uttar Pradesh, India to the following submissions as follows.

1-It is submitted before the Hon’ble Sir that following is the message displaying on the Top of the R.T.I. portal of the government of Uttar Pradesh.

Moreover, the instructions on the home page of the portal clearly indicate viz. Please do not file RTI applications through this portal for the public authorities under the State Governments, including Govt. of Uttar Pradesh. If filed, the application would be returned, without refund of amount. Accordingly, your RTI application, which is the concern of a public authority under any State Government, is returned herewith. You may file the same before the concerned public authority under the State Government.

the public authority, to which such application is made, shall transfer the application or such part of it as may be appropriate to that other public authority and inform the applicant immediately about such transfer:

Provided that the transfer of an application pursuant to this sub-section shall be made as soon as practicable but in no case later than five days from the date of receipt of the application.

PIO has made a practice to deny the sought information arbitrarily by falsely taking recourse of section 5 of U.P. RTI Rules, 2015. Parrot denial of sought information by the Nodal officer is the mockery of Right to Information Act 2005. They do not know even the simple rule that PIO provides its name and designation as well as name and designation of the First Appellate Authority in the communication. The matter is concerned with bribe taken by ADO Panchayat and the team has been formed by D.M. but CPIO Nodal officer escaping from providing sought information on flimsy ground

2-It is submitted before the Hon’ble Sir that I have already made the representation in regard to mockery of Right to Information Act 2005 by the state public information officer of the same department and now illegal stand is being upheld by First Appellate Authority.

3-It is submitted before the Hon’ble Sir that think about the gravity of situation that bribes are taken in the name of senior rank officers and matter is brought up before the accountable public functionaries but no action is taken. Whether it is rule of law and government is running according to provisions of the constitution of India?

Audio visual evidence of bribe of Rs.100000.00 taken by A.D.O. panchayat but no action yet ongoing incumbent in the state is honest. Entire Mirzapur knows the fact but intelligence of state government is so weak that they are not apprised with this scandal.

This is a humble request of your appellant to you Hon’ble Sir that how can it be justified to withhold public services arbitrarily and promote anarchy, lawlessness and chaos in an arbitrary manner by making the mockery of law of land? There is need of the hour to take harsh steps against the wrongdoer in order to win the confidence of citizenry and strengthen the democratic values for healthy and prosperous democracy. For this, your appellant shall ever pray you, Hon’ble Sir.

    और इसकी जांच कर कार्रवाई की मांग की है। स्थानीय लोगों की मानें तो छानबे ब्लाक के दुगौली ग्राम पंचायत में

    और जल्द ही मामले का खुलासा किया जाएगा।

  2. To escape from providing the sought information to Information seeker is the reflection of anarchy in the government machinery.

There is rampant corruption in the government machinery which is quite obvious from the corrupt dealings of the erring Public Information officers of the Government of Uttar Pradesh and the first appellate authority concerned who are not providing information to the information seekers on flimsy ground and false and fabricated grounds created by them themselves. It seems that government of Uttar Pradesh has thrown The Right to Information act 2005 into dustbin which is quite obvious from its working style.
