Prayer-CPIO didn’t comply the provisions of Right to  Information Act 2005 and denied the sought information in a cryptic manner. Since the sought information was denied in wilful and deliberate manner so pecuniary penalty may be imposed as sanction on him as prescribed under section 20 of Right to  Information Act 2005 with time-bound compliance of the order so that others may not be promoted to indulge in such unethical and illegal practice which may promote the rampant corruption in the working of public authority Indian Oil Corporation Limited. First appellate authority instead of being instrumental in providing the sought information tried to shield the illegal work of CPIO by shifting the focus on an unproductive issue so that wrongdoing of the staffs concerned may be concealed. Therefore concerned public authority may be directed to take disciplinary action against First appellate authority.

Whether it can justifiable to mislead the senior rank officers by false statements as being done by the staffs of the Indian Oil Corporation Limited Concerned syphoned millions of public fund meant to the poor citizenry on flimsy ground and now when their cryptic claims of depriving the poor citizenry of rural area from subsidized gas cylinders are being proved futile, then they are disturbed and saying that document attached by the applicant is concerned with the Aadhaar correction not concerned with the subsidy. Here this question arises that whether action would be taken against wrongdoer staffs of the Indian Oil Corporation Limited If there is a fragment of honesty in the concerned accountable public functionaries, then they ought to take harsh steps against wrongdoers who are stating falsely that attached documents are concerned with Aadhaar correction instead of the gas subsidy. Either they have no knowledge of English or concealing the facts deliberately ipso facto obvious.

Undoubtedly matter is concerned with the deep-rooted corruption which has deprived thousands of poor of the subsidised domestic gas cylinders arbitrarily and subsidy was disbursed among corrupt staffs of the department. Here this question arises that when the direction of the petroleum ministry was available to them, why concerned overlooked the circular and remained indulged in the corrupt activity to deprive poor villagers of subsidised gas cylinders. How the justice will be available to weaker and downtrodden section if such procrastination will be made by responsible staffs in regard to fix accountability of corrupts who syphoned the subsidy of the poor villagers. Undoubtedly concerned corrupts public staffs want to throw the matter in the dustbin without taking any action so they are procrastinating in the matter when there is ample evidence of wrongdoings. Whether to shield wrongdoers instead of taking action against them will not promote corruption in the system. O God save us

Poor villages were deprived of the subsidy provided by the government on the domestic gas cylinders arbitrarily even they overlooked the direction given by the Ministry of Petroleum by taking the senior rank officers under good faith but now they are running away from providing information because they know that if they will provide information their wrongdoings will be exposed before the public as the information will go into the public domain so they are running away to provide the information to the information seeker but such practices must be stopped.

Undoubtedly this matter is concerned with the deep rooted corruption in the government machinery and earlier this matter has been taken up on the same Forum and the Chief Information Commissioner of India did not provide proper relief to the aggrieved people and I don’t think that this time new Chief Information Commissioner will do anything better because individuals are changed at the post but working style remains same.

Insensitivity of government functionaries towards the issues concerned with wider public interest always proved to fatal and same thing happened to Right to Information Act 2005 and now this act has been without teeth and nail. Sought information -3-Total number of consumers whose withheld subsidy was refunded to comply with subsequent circular of the ministry concerned.
They did not provide the list which means their credibility is in dark.

Undoubtedly made available information is complete misleading and an act to cover the corrupt practices under carpet. Earlier matter was raised but former Chief Information Commissioner only made an attempt to save the skin. If enquiry was ordered, then outcome remains positive but most troublesome in this largest democracy in the world is that from top to bottom corrupt practices are shielded which is root cause of our deterioration.
