To

RECORD OF PROCEEDINGS

Writ Petition(s)(Civil)  No(s).1224/2017

INITIATIVES FOR INCLUSION FOUNDATION & ANR.        Petitioner(s)

VERSUS

UNION OF INDIA & ORS.                              Respondent(s)

Hon’ble Sir from the attached documents, it is quite obvious that according to the government of Uttar Pradesh, regarding information about the constitution of Internal Complaint Committees only 11 departments have made available the information out of 94 departments.

Most revered Sir –Your applicant invites the kind attention of Hon’ble Sir with due respect to the following submissions as follows.

1-It is submitted before the Hon’ble Sir that  51A. Fundamental duties It shall be the duty of every citizen of India (a) to abide by the Constitution and respect its ideals and institutions, the National Flag and the National Anthem;(h) to develop the scientific temper, humanism and the spirit of inquiry and reform;

(i) to safeguard public property and to abjure violence;

(j) to strive towards excellence in all spheres of individual and collective activity so that the nation constantly rises to higher levels of endeavour and achievement.

2-It is to be submitted before the Hon’ble Sir that following is the initiative of the central government.

Ministry of Women & Child Development (Women Welfare Division ) Govt. of India vide an O.M.No.16/1/2018-WW dated 02.05.2018 has sought information about the constitution of Internal Complaint Committees in respect of Ministries/ Departments along with Attached/ Subordinate/PSUs Offices, for implementation of Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013.

3-It is to be submitted before the Hon’ble Sir that from the attached document to the representation it is quite obvious that six reminders have been sent for the constitution of Internal Complaint Committees but the outcome remained zero.

4-It is to be submitted before the Hon’ble Sir that implementation of Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013 which means we remained failed to implement the rule passed by our rulemaking bodies even in seven years.

5-It is to be submitted before the Hon’ble Sir that whether we are not failed to provide justice to the weaker and vulnerable section especially women constituting one half of total population of the country because of tyranny and arbitrariness in the bureaucracy in the state of Uttar Pradesh. Nowadays mental and physical torture of women at the workplace is quite common which culminates into suicide and murder but insensitive responsible functionaries are overlooking such matters of wide public interests.

खुदा भी आसमाँ से जब जमी पे देखता होगा |

इस मेरे प्यारे देश को क्या हुआ सोचता होगा||

This is a humble request of your applicant to you Hon’ble Sir that how can it be justified to withhold public services arbitrarily and promote anarchy, lawlessness and chaos arbitrarily by making the mockery of law of land? There is need of the hour to take harsh steps against the wrongdoer to win the confidence of citizenry and strengthen the democratic values for healthy and prosperous democracy. For this, your applicant shall ever pray you, Hon’ble Sir.

Date-21/08/2020           Yours sincerely

Here this question arises that if there is demand of internal complaint committee in the Departments of the Government of India and the legislation has been passed then why not implementation is being carried out by the senior bureaucrats in the state as well as centre? Think about the gravity of situation that lady doctor was murdered and medical officer has been arrested for the murder which is showing that government of Uttar Pradesh is adopting a lackadaisical approach in implementing the legislation passed by the central government.

Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013.It is unfortunate that this act is failed because of rampant corruption and incompetence of the public functionaries in this largest democracy in the world. Think about the barbaric murder of junior Doctor Yogita Gautam as her fault is to deny the immoral pressure of senior rank staff. Whether government of Uttar Pradesh will compensate this murder as it is outcome of its failure.

Whether government of Uttar Pradesh has no effective control over its subordinated departments as they are overlooking the direction of the government specially chief minister office.
