Whether to serve third grade substandard grain to children is not tantamount to food poisoning . What we have learnt from the tragic incidents took place in other states and in our state just in Azamgarh district where several children fell ill because of third grade substandard meal was served to them in the school for mute and dumb children.
With due respect .your applicant wants to draw the kind attention of the Hon’ble Sir to the following submissions as follows.            
1-It is submitted before the Hon’ble Sir that Hon’ble Sir please take the perusal of Amar Ujala daily ,page-7 on Wednesday i.e. 23-April-2014 . According to report, in primary school situated at Gram panchayat Bhadawal , Block-Jamalpur in District-Mirzapur , children demonstrated by beating plate and thali when served bad quality third grade mid day meal by the department of primary education ,government of Uttar Pradesh .The guardians reached at the school made complaint to ABSA . Guardians agitated were pacified on the assurance of taking action against the head master. These children were angry with the third grade rice served to them in mid day meal . Because of this carelessness of the department ,both children and their guardians were too much angered . In the school only one Shiksha Mitra was present who made his best effort to pacify the children but their fury couldn’t be pacified by him while the other staffs including headmaster were absent. The ABRC sent by department of primary education to the school on complaint found served mid day meal lacks quality and unhygienic . 2-It is submitted before the Hon’ble Sir that Here is the notice as served to aforesaid officer which content is as follows.

Letter petition was submitted/put up before the commission today .The copy of application may be sent to commissioner, Azamgarh division with the direction that enquiry report concerned with the matter may be sent to commission within one month.

विद्यालय में फूड प्वायजनिंग से बच्चों की हालत गंभीर होने की सूचना मिलते ही जिला प्रशासन में हड़कंप मच गया था। मुख्य चिकित्साधिकारी डाबीबी सिंहबेसिक शिक्षा अधिकारी राकेशखाद्य निरीक्षक अभय कुमार आदि मौके पर पहुंच गए। सीएमओ ने बताया कि जांच में पाया गया कि रात को जो भोजन बना थावह अधपका थाउसे खाने से बच्चों को अपच हो गई। भोजन का नमूना लिया गया है। जांच रिपोर्ट आने के बाद दोषी के विरुद्ध कार्रवाई की जाएगी।
2-It is submitted before the Hon’ble Sir that according to warden Usha -in the night of Tuesday ,Children were served pulses ,rice and chapatis . In the morning of Wednesday few children made complaint of stomach-ache .Thereafter one by one ,19 children became tired and got exhausted because of pain and omitting . When the situation got out of control ,then all the diseased children were admitted to district hospital Azam Garh where after primary remedy/treatment 12 children were returned back but 7 students were still undergoing treatment. Dr. P.K. Jha made the apprehension of food poisoning. Attempts are being made for proper treatment of serious students.
3-It is submitted before the Hon’ble Sir that 
Convention on the Rights of the Child
An inherent right to live, survival and development
 Freedom from discrimination based on race, religion, colour, sex or disability
 Governments and courts must make the best interests of the child a primary consideration
 Ensure the protection, safety and health of the child
 Right to be registered immediately after birth, to have a name and a nationality and to be cared for by parents
Protection from unlawful interference
 Protection by the state from all forms of physical or mental violence, injury or abuse, neglect or negligent treatment, maltreatment or exploitation, including sexual abuse
 A mentally or physically disabled child should enjoy a full and decent life, in conditions which ensure dignity, promote self-reliance and facilitate the child’s active participation in the community
This is humble request of your applicant to you Hon’ble Sir that India is signatory member of all conventions of U.N. mostly. Whether these rights of children are safe in India. Here instead of safeguarding measures ,public functionaries make attempts to conceal such violations. Please take effective steps in the concerned matter . For this your applicant shall ever pray you Hon’ble Sir.

  2. If the action will not be taken by accountable functionaries , then such wrongdoings will remain quite common in the system. Here to serve notice is not solution ,but latter action must be taken. There are so many cases where evidence against the wrongdoers is proved but competent authorities didn't take action on the representation.
