Grievance Description
The matter concerns the working of the officer in charge of Police Station: Panchla under the supervision of the superintendent of police of the district concerned. District: Howrah, State: West Bengal
Grabbing of house and house trespass took place due to inaction and lack of alertness of the concerned police personal. Whether it is not failure of the law-order in the state which is the states subject.
Property Owner - Mr. Musharaf Mulla S/o Late Abdul Matleb Mulla.
The applicant is currently living at the following address.

Most respected sir, on behalf of the applicant the following relative of the applicant visited the nearby police station to make a complaint regarding the grabbing and house trespass by the offenders.

It is most unfortunate that the concerned police personnel overlooked the complaint of the representative of the applicant.
Most respected sir, please take a glance of the following case which has been disposed of in favour of applicant and appropriate order has been passed which compliance was made with the help of police by depositing the required charges of the police.

The date is fixed for passing order over on petition dated 05.08.2017. Accordingly, the record is taken up for passing order.
From the record, it appears that cost of Police assistance had already been deposited by the Decree holder as per the assessments given by the S.P. Rural vide his Memo no.1817/E, dated 30.08.2013 for 02 S.1. 02 ASI. 06 Constable and 04 Lady Constable amounting to total 13.362/-. Therefore. I find that cost of police assistance has already been deposited through T.R no.7. The xerox copy of the same is already on record
Accordingly, the petition dated 05.08.2017 is allowed. O/C. Panchla is therefore directed to provide police assistance for proper execution of the writ on the date and time fixed herein under.
The office is directed to issue writ for delivery of possession at once.

An enquiry under Article 51 A of the constitution of India with the officer in charge of the concerned police station.
1- Please provide the status of the execution of the order of the most respected court by the officer in charge of Panchkula and concerned police personnel in matters under reference.
2- How the right to property is safeguarded by the government of state if the property of a person is no more safe in the state if a person is residing out of the state for earning livelihood for living being.
3- It is an obligatory duty of the concerned police personnel to implicate the offenders under the following sections of the Bharatiya nyaay Sanghita which are as follows-
SECTION 329 BNS - Bharatiya Nyaya Sanhita 2023 of Criminal trespass and house-trespass, SECTION 330 BNS - Bharatiya Nyaya Sanhita 2023 of House-trespass and house-breaking, SECTION 331 BNS - Bharatiya Nyaya Sanhita 2023 for Punishment for house-trespass or house breaking, SECTION 332 BNS - Bharatiya Nyaya Sanhita 2023 of House-trespass in order to commit offence, SECTION 333 BNS - Bharatiya Nyaya Sanhita 2023 of House-trespass after preparation for hurt, assault or wrongful restraint.
The applicant is suffering from cardiovascular diseases quite obvious from the treatment receipts attached to the grievance so be kind to the applicant and provide me justice in accordance with the law.
