. आवेदक/शिकायतकर्ता का बयान.-श्रीमती किरन सिंह पुत्री श्री नरेंद्र प्रताप सिंह निवासी 569 /टी 46 अलीनगर सुनहरा थाना कृष्णानगर लखनऊ मोबाइल नंबर- 8687594247 पर रही है कि मेरा एक प्लाट सरकार क्षेत्रफल 2015 वर्गफट है जिसे श्रीमती शिमला देवी पत्नी रामसहाय से क्रय किया था उसी से सटा हुआ भाग पूर्व दिशा श्रीमती विद्यावती पत्नी राधेश्याम निवासी 39 लक्ष्मपुरी फैजाबाद रोड लखनऊ का है जिसमें मनोज कुमार सोलंकी व कमला दयाल ने 700 वर्गफीट जमीन का वेनामा कराया था। आवेदक की निजी सड़क को विरोधियों द्वारा सार्वजनिक सड़क की तरह उपयोग किया जा रहा है और सबमर्सिबल पंप और दिवार निर्माण जैसे अन्य कार्यों के माध्यम से हमारी निजी सड़क को हड़प रहे हैं। For more details, please take a glance at the attached report of the sub inspector to the online rti application. This report of the sub inspector has been submitted by the assistant commissioner of police krishna Nagar Lucknow on the public grievance portal dated 13th October 2024.
Public information officer in the office of Commissioner of police lucknow must provide the following information point wise to the information seeker as follows.
1-From the report it is quite obvious that the applicant told the concerned investigation officer of the police that the plot of the land was purchased from Shimla Devi W/O Ram Sahai and the opposition party purchased the land from Vidyavati Devi W/O Radhey Shyam. Here this question arises whether Vidyavati Devi W/O Radhey Shyam has provided any road to the opposite party if not then how they can claim any road. Most respected Sir this road belongs to the applicant and is a part of agreement between the landowner Shimla Devi wife of Ram Sahai quite obvious from the agreement made between the applicant and the landowner in the police station.
Please provide the information on the private road claimed by the applicant whether belongs to Shimla Devi W/O Ram Sahai or Vidyavati Devi W/O Radhey Shyam as an integral part of Investigation by sub inspectors.
2- Private road of the information seeker was grabbed by opposite parties by keeping the station house officer police situation- Krishna Nagar under Good faith. Consequently the family members of the information seeker including information seeker were confined to the Krishnanagar police station by SHO.
Please provide the provision of law which states that grabbing of land by colluding with the police is dealt under the civil procedure code.
3- Please provide the posting details of Kamla Dayal and Manoj Kumar Solanki who belong to the police and the date when they joined the Commissionerate of police Lucknow and their earlier posting details.

Most respected sir, concerned investigation officer repeatedly submitting the bogus, inconsistent and arbitrary reports in the matter by concealing the facts and submitting the manipulated facts and misleading the senior rank officer in the matter.
Most respected sir, the report submitted by the investigation officer in the following grievance

is as follows.
Brief analysis of evidence- It is respectfully informed that when the application of the applicant was investigated by the S.I. on the spot, it was found that the applicant Mrs. Kiran had a plot with a total area of 2615 sq. ft. (as per the statement of applicant) which was purchased from Shimla Devi W/O Ramsahay, the adjacent portion in the east direction belonged to Mrs. Vidyavati wife of late Radheshyam resident of 39 Laxmanpuri Faizabad Road Lucknow, out of which Manoj Kumar Solanki and Kamla Dayal had got the deed of 700 sq. ft. of land, whose mutation has been done on 05.01.2022. On visiting the spot, it was found that the applicant has a plot adjacent to the main road leading to C-pad, behind which is the house of the opponents. For the opponents to pass through, there is a path next to the applicant's plot, which was 5 to 6 feet deep in the past, due to which it used to get filled with water during the rainy season. The opponents were facing the problem of passing through since the plot of applicant is lying vacant, which is 3 to 4 feet deep from the main road. To solve this problem, the opponents have made a boundary road equal to the height of the road to stop the soil and put soil in it to make the deep path suitable for movement. Regarding which the applicant alleges that apart from the land of the road, the opponents have also occupied the land of my plot. The matter is related to revenue.
Most respected sir, please take a glance of the following points.
1- The landlord of the applicant and the landlord of the opponents are different.
2-The road is land belongs to landlord of applicant not opponents.
3-The road belongs to applicant as agreement with landlord.
4-The opponents may confine to their plots but not so as they are using the private road of the applicant as public road by installing submersible pumps and other activities.
5- The report of the police is speaking the language of the opponents.
