practises may not promote in the system as they are setting up bad precedent
for future generation.

of the appellant are as follows.
1- From the
following status, it is obvious that the appellant submitted the RTI
application on 29th May 2024 which was received in the office of nodal officer
and forwarded to the public information officer on 3rd June 2024. It is 17th
September 2024, but the concerned public information officer did not entertain
the RTI application which is violation of subsection 1 of section 7 of the
right to information act 2005.

3-Right to
information act 2005 was introduced by the government of India to promote
transparency and accountability in the working of public authorities but it
seems that the current governments in the state and centre has put the this
special act into a dustbin.
4-Quantum of
negligence can be guessed from the fact that they are not entertaining the RTI
applications even after the expiry of the time as stipulated 30 days prescribed
under subsection one of section 7 of the right to information act 2005.
5-It is obvious
that the matter concerns arbitrariness, tyranny and corruption in the working
of public authority. Which is the root cause public information officers of the
concerned public authority are running away from providing information to the
information seeker because they are frightening to be exposed in public domain
if their working will reach in public.
6-This special act
was brought up by the government of India to control the growing corruption in
the government machinery, but it seems that corruption itself diluting the
provisions of this special act.
7-A man is not
great by birth, but he is great by his deeds and creation, but it seems that
our generation has forgotten these quotes. Whether the public information
officer is frightened of the fear of penal action. Why has he taken provisions
of the right information act under teeth?
8- The appellant
sought following information from the public information officer as follows.

Please provide the name and designation of the staff in the
office of Executive Engineer Electricity Distribution Division 1st Mr Yogesh Kumar who is processing the aforementioned
grievance.
2- Through this Grievance registration number:
GOVUP/E/2024/0030478 the information seeker submitted
the reply of the notice served by executive engineer electricity distribution
division first Mr Yogesh Kumar on 15 April 2024 to the aggrieved lady Hakimun
Nisha W/O Sami Ullah.
Please provide the notings made by the competent staff of the
public authority on the grievance made by the information seeker.
3-The applicant has written many applications seeking the
video footage made by them of the premises but they are not providing the
videography to the applicant which indicates the lack of transparency and
accountability in the working of the anti-power theft police district Mirzapur.

Mirzapur must provide the CD of the videography made by the vigilance team
which proves their cryptic allegations of theft of electricity against
vulnerable Lady Hakeemun Nisha as well as executive engineer electricity
distribution division 1st must provide the CD of the videography made by the
team of the department on the application of the information seeker against
false reporting of vigilance team.
This is a humble request of your appellant
to you Hon'ble Sir that how can it be justified to withhold public services
arbitrarily and promote anarchy, lawlessness, and chaos arbitrarily by making
the mockery of law of land? There is need of the hour to take harsh steps
against the wrongdoer to win the confidence of citizenry and strengthen the
democratic values for healthy and prosperous democracy. For this, your
appellant shall ever pray for you, Hon’ble Sir.
