Grievance Description
The matter concerns the working of the registry of the Uttar Pradesh state information commission and prevailed corruption in its working.
There are two types of evidence of corruption.
1- Direct evidence and
2- Circumstantial evidence.
Undoubtedly there is no direct evidence of corruption but cryptic and mysterious activity of the research officer indicating the circumstantial evidence of corruption. It is quite obvious that the research officer of the Uttar Pradesh state information commission created deficiency in the second appeal deliberately which is tantamount to indiscipline so action must be taken against him.It is most unfortunate that he could not see the mockery of the provisions of the right to information act 2005 by the staff of the public authority that they did not entertain RTI application as well as appeal still. When no communications were exchanged by PIO and FAA with the appellant, then how can the research officer expect such documents from the appellant? महोदय ,
आपके द्वारा आयोग में दिनांक : 25-01-2024 को एक द्वितीय अपील (सूचना का अधिकार अधिनियम, 2005 की धारा 19(3) के अधीन द्वितीय अपील) प्रस्तुत की गयी है जिसमे रजिस्ट्री स्तर पर जाँच के उपरांत निम्नलिखित त्रुटि पायी है:
1) राज्य लोक सूचना अधिकारी से उत्तर प्राप्त की प्रति संलग्न नहीं हैReply of the appellant -Public information officer did not provide any information to the appellant yet. The status of the RTI application of the appellant is attached as the document-1 of the second appeal submitted by the appellant.
2) आयोग के समक्ष अधिनियम की धारा 19(3) के तहत प्रस्तुत द्वितीय अपील के साथ, प्रथम अपीलीय प्राधिकारी के समक्ष अधिनियम की धारा 19(1) के तहत दायर की गयी प्रथम अपील की प्रति संलग्न नहीं हैReply of the appellant-धारा 19(1) के तहत प्रथम अपील की प्रति Most respected sir the appeal is submitted by the appellant on the rti portal of the government of Uttar Pradesh, it is attached to the second appeal but that was not clicked by the research officer reflects the dereliction of duty of the research officer.
3) प्रथम अपीलीय अधिकारी से कोई प्राप्त आदेश की प्रति संलग्न नहीं हैReply of the appellant- When the first appellate authority did not take any action on the appeal of the appellant how can the appellant provide the copy of the order of the first affiliate authority?

टिप्पणी : धारा 19-1और धारा 19-3 के सीमाकाल के अनुसार अपील की जानी चाहिए जिसका पालन नहीं किया गया।RTI application forwarded on REQUEST FORWARDED TO PIO as on 30/11/2023. Time to provide information under subsection 1 of section 7 of RTI Act 2005 is 30 days. Date of first appeal-14-01-2024The appellant submitted the appeal within 15 days from the date of expiry to provide information. Secretary of the commission itself accepted in its communication with appellant that the registry of the commission has no power to reject rti appeal. Second appeal was made on 25 Jan 2024 and REQUEST FORWARDED TO PIO as on 30/11/2023 which means time gap is 2 months 26 days which is less than 90 days.
अतः आपके द्वारा प्रस्तुत द्वितीय अपील (सूचना का अधिकार अधिनियम, 2005 की धारा 19(3) के अधीन द्वितीय अपील) को संग्लग्न पर वापस करते हुए आपको परामर्श दिया जाता है, कि इस पत्र में इंगित की गयी त्रुटि दूर करते हुए पुनः आयोग को अपनी द्वितीय अपील (सूचना का अधिकार अधिनियम, 2005 की धारा 19(3) के अधीन द्वितीय अपील) प्रस्तुत कर सकते हैं

Most respected sir how can it be justify that the application concerning with the working of the Uttar Pradesh state information commission must be sent to the commissioner of police Lucknow? How can it be possible that matter concerning with the working of upsic may be sent by the staff of chief minister office to the commissioner of police Lucknow? Undoubtedly you are providing good governance Yogi sir. Details of action- I want to inform you about the case. When the application form of the applicant was perused, it was found that the facts mentioned by the applicant in his application form are related to the Uttar Pradesh Information Commission, as the application form has also been mentioned by the applicant himself. Please do not require any other action in the matter from your side. Kindly send the application for depositing the case.
