Applicant Ms.Aarti Prakash Kadam Age 40 Years Occupation-Housework Ra Room No.234 Chowkute Chal Dandpada Near Siddhivinayak Mandir 20th Road Khar Paschim Mumbai 52 perused the application.

On 16/02/2022 when we came to Mauje Chandrapada Vakipada Naigaon old survey no 495 and new survey no 107 said place there was an office named M/s Dubey Developers. Builders name was Rupesh Dubey. When the builder told us that we need a room, the builder showed us the Shivkripa apartment building near his office and said that the construction of the said room is in progress. The room will be handed over to you after your early payment. Me and my husband after looking at the rooms in the whole building we got Shivkripa Apartment Building No. 02 Room No. 102 First Floor 390 Sq. We decided to take the room as we liked the room with foot carpet. The total cost of the room is said to be around Rs.8,25,000/-. We are ready to do the said transaction. And the builder said that the transaction of payment was done by signing a memorandum of understanding on a stamp paper of Rs.

A memorandum of understanding/agreement dated 28/02/2022 was agreed to pay the total cost of 1 room by check payment of Rs. The builder told us that he will give us possession of the room till 20th April 2022. And the builder told us in front of us that if I don't give you a room in Yeli then I will return your money. As a rule, the builder gave us a check of Rs. For this, a check/cash has been given to Builders from Mado Account as follows to Dubey Developers as follows:

However, a total amount of Rs.5,10,000/- has been paid to the builder during the period from 18/02/2022 to 24/02/2022 as per the agreed transaction. The builder did not prepare the room we purchased within the specified time. So my husband contacted the builder Rupesh Dubey on his mobile and the builder started wasting time saying that he will give the room, so me and my husband we met in Rupesh Dubey's office during June 2022 and Rupesh Dubey told me that due to technical problems I am selling you the room. will not come Then we inquired about returning the money we had paid for the room, but Rupesh Dubey kept refusing to give us back the nominal amount that we had taken, giving some reason every time. He told us that apak paisa nahi deta hu ja apak kya karna hai karo aur paisa baere te aye to apak mar mar ke bhaga duga as he threatened. After gaining our trust, he notarized the Memorandum of Adherishing Agreement with us and said that he is giving the room from my side, and has committed a financial fraud of a total amount of Rs. 5,10,000/-.

However, the applicant on 16/02/2022, Mauje Chandrapada Vakipada Naigaon Old Survey No. 495 and New Survey No. 107 Building Shivkripa Apart Building No. 02 Room No. 102 First Floor 390 Sq. Although the non-applicant was given a check/cash amount of around Rs.5,10,000/- for the room, the non-applicant cheated the applicant by not giving the room and threatened him that he would not pay.

However, since the preliminary investigation reveals that the non-applicant has cheated the applicant. A letter dated 31/08/2024 has been sent to the office of Hon'ble Police Commissioner  Vasai to get permission to file a case against the non-applicant under Section 420,506 of IPC. The said application will be included in the case.

Grievance Detail

Short submissions of the applicant are as follows.

1- A Memorandum of Understanding/Agreement has been made and entered into at NAIGAON, on 28th February 2022 BEWTEEN MR, RUPESH BIJAY SHANKAR DUBEY, Adult/s, Indian. Inhabitant/s, having address at SHIV KRUPA APT NEAR SHANTI GOVIND SCHOOL, CHANDRAPADA NAIGAON EAST Tal and Dist PALGHAR-401207, hereinafter referred to as the Party of the First Part(Which expression shall mean and include is heirs, partners, executors, administrators, assigns, etc.) AND MRS.AARTI PRAKASH KADAM, Adult, Indian Inhabitant, having address at KHAR, DANDA PADA,234 CHAWKUTE, CHAWL 20TH ROAD NEAR SIDDHIVINAYAK MANDIR KHAR WEST MUME 400052. (Which expression shall mean and include is heirs, partners, executors, administrators, assigns, etc.) hereinafter referred to as the Party of the Second Part.

2- The applicant paid Rs.510000 to the first party of the agreement. The mode of payment was Rs.10000 as cash and rest of amount through three cheques of the State Bank of India two of them was of Rs.2 Lakhs each and rest one was 1 lakh rupees amount.

3-Meanwhile both the parties reached on mutual understanding to cancel the contract made between the parties.

4- it is quite obvious from the attached document to the Grievance, two cheques were issued by the first party, one on the 25th April 2022 and second on 30th April 2022 but both the cheques were bounced when applicant made effort to redeem the cheques.

5- Two blanks cheques were provided by the first party to the applicant but those blank cheques which have to be redeemed in the year 2023 could not reap any benefits for the applicant.

6-Section 138. Dishonour of cheque for insufficiency, etc., of funds in the account.1Where any cheque drawn by a person on an account maintained by him with a banker for payment of any amount of money to another person from out of that account for the discharge, in whole or in part, of any debt or other liability, is returned by the bank unpaid, either because of the amount of money standing to the credit of that account is insufficient to honour the cheque or that it exceeds the amount arranged to be paid from that account by an agreement made with that bank, such person shall be deemed to have committed an offence and shall, without prejudice to any other provision of this Act, be punished with imprisonment for 2a term which may be extended to two years, or with fine which may extend to twice the amount of the cheque, or with both:

7- The applicant submitted the representation before the senior inspector having jurisdiction to the matter concerned and concerned commissioner of police and those representations are attached to the grievance as pages of attached PDF document. The applicant wants to know the action taken by the concerned police and those representations of the applicant.

This is a humble request of the applicant to take action against the real state Mafia cheating the innocent and gullible people under appropriate sections of Indian penal code. Please be instrumental in the repayment of the deposited money of the applicant.
