Prayer- Public information officer arbitrarily denied the information and First appellate authority First Appellate Authority did not take any action on it illegally without considering the pros and cons of the result. Please take action against the public information officer under section 20 of the right to information act 2005 and order disciplinary action against the working of the first appellate authority for withholding the information by overlooking the first appeal and keeping itself mute on the denial of information.
Short submissions of the appellant are as follows.
1- Reply of the PIO:- The work of filling the annual movable and immovable property statement by the officers of Uttar Pradesh Civil Services through online medium on Sparrow Portal is not worked and monitored at the directorate level. Hence, the desired information is not held at the Directorate level.
Submission-Sir, please refer to pages 4 and 5 of the PDF documents attached with this appeal. The government order was sent by Dhananjay Shukla, Special Secretary of the Government of Uttar Pradesh on 4th January 2024. This mandate is addressed to the Chairman Revenue Council Uttar Pradesh Lucknow, all Additional Chief Secretary, Principal Secretary, Secretary, Government of Uttar Pradesh, all the heads of departments and chief office heads, Uttar Pradesh all the divisional commissioners of Uttar Pradesh, the District Magistrate of Uttar Pradesh.
2- Submission- Director at the directorate local body Lucknow had to direct subordinates specially provincial civil servants to submit Entire movable and immovable property details on the Sparrow Portal of the government of Uttar Pradesh by using their ID and passwords.
3- Submission- This implies that the Director at the directorate local body Lucknow did not ensure the compliance of the government order sent through the special secretary of the government of Uttar Pradesh Mr Dhananjay Shukla on 4th January 2024.
4- Submission- Here one thing must be noted that the information seeker is not seeking information concerning the declaration of assets but the appellant is seeking information regarding the compliance of the government order and communications exchanged regarding it by the accountable officer of the government.
5- Submission- It is most unfortunate that the public information officer denied the information on the ground that The work of filling the annual movable and immovable property statement by the officers of Uttar Pradesh Civil Services through online medium on Sparrow Portal is not worked and monitored at the directorate level. Hence, the desired information is not held at the Directorate level..
6- Submission- This implies that the director of the Directorate local body Lucknow did not make compliance of the government order by directing the subordinates to submit their both movable and immovable properties on the Sparrow Portal by using their ID and password. This is not the mistake of the fact but it is a mistake of the law and tantamount to indiscipline in performing the public duty. It is not expected from such a senior rank officer who has retained such a highest level of responsibilities.
7-Submission-Think about the ancient monarchies when the people were awarded capital punishment for violating the orders of the Kings but at present such government orders are put into the dustbin.
Whether it is not a failure of the democracy in the country and is not reflecting the anarchy in the working of the government machinery because of such an arrogant working style.
What is the need to amass huge wealth disproportionate to known sources of income because such a step is causing one to escape from following the government order?
This is a humble request of your applicant to you Hon'ble Sir that how can it be justified to withhold public services arbitrarily and promote anarchy, lawlessness, and chaos arbitrarily by making the mockery of law of land? There is need of the hour to take harsh steps against the wrongdoer to win the confidence of citizenry and strengthen the democratic values for healthy and prosperous democracy. For this, your appellant shall ever pray for you, Hon’ble Sir.
