Prayer- Public information officer did not entertain RTI application within time 30 days as prescribed under subsection 1 of section 7 of the right to information act 2005 and still they have not provided any information. First appellate authority also did not entertain the RTI appeal submitted by the appellant online.

Short submissions of the appellant are as follows.

1-From the following status of the RTI application it is quite obvious that the appellant submitted the rti application on 23rd January 2024 which was forwarded by the nodal officer to the concerned public information officer on 27th January 2024 whose mobile number and email id are given below in the status of the rti application.

2-It is 13th July 2024 today which means more than 5 months passed but concerned public information officer did not provide information to the information seeker and most surprising thing is that the concerned public information officer did not deem it fit to exchange communication with the appellant regarding the non-availability of information to the appellant by the public information officer.

3- Most respected sir please take a glance of the status of the RTI application submitted by the appellant on the RTI portal of the government of Uttar Pradesh.

4-Now the appellant wants to draw the kind attention of the first appellate authority to subsection 1 of section 7 of the right to information act 2005 which prescribes the time to provide information to the information seeker. According to this provision of the right to information act 2005, a public information officer has to provide information to the information seeker within stipulated 30 days from the date of receipt of the rti application in the office of the public authority.

5-Thus we observe that the concerned public information officer violated subsection one of section 7 of the right to information act 2005 so pecuniary penalty must be imposed against the public information officer concerned under section 20 of the right to information act 2005, as well as the public information officer must be directed to provide information to the appellant as soon as possible.

6-The right to information act 2005 was introduced by the government of India to promote transparency and accountability in the working of the public authorities, but it is most unfortunate after 19 years of the implementation of the right to information act 2005, public information officers are not providing any information to the information seekers except in a few cases.

This is a humble request of the appellant to the first appellate authority to take appropriate action in the matter as required under the law.

7-The appellant is seeking information concerning the compliance of the government order regarding the voluntary disclosure of assets by the provincial civil servants on the sparrow portal of the government, but it seems that the concerned public information officer did not understand the contents of the rti application which is itself a matter of concern.

8- Most respected sir the appellant sought following information from public information officer.

1-Provide the name and designation of the staff who disclosed the assets voluntarily up to 31 January 2024.

2- Provide the name and designation of the staff who did not disclose their assets voluntarily by 31st January 2024.

3- Provide the action taken by commissioner of police, district Prayagraj regarding the government order dated 4th January 2024.

4- Provide the copy of the communications exchanged with the subordinates by the commissioner of police district Prayagraj in compliance with the government order concerning disclosure of assets voluntarily.

5- Provide the name and resignation of the staff who is processing this government order in the office of Commissioner of police district Prayagraj.

This is a humble request of your applicant to you Hon'ble Sir that how can it be justified to withhold public services arbitrarily and promote anarchy, lawlessness, and chaos arbitrarily by making the mockery of law of land? There is need of the hour to take harsh steps against the wrongdoer to win the confidence of citizenry and strengthen the democratic values for healthy and prosperous democracy. For this, your appellant shall ever pray for you, Hon’ble Sir.
