RTI application within time 30 days as prescribed under subsection 1 of section
7 of the right to information act 2005 and still he has not provided any
information. No correspondence has been made by public information officer
regarding to provide information yet.

From the following order of the first appellate
authority, it is obvious that public information officer had not provided any
information to the appellant, and he did not provide any information in
compliance with the order passed by the first appellate authority as follows.

की धारा-6 (1) के अन्तर्गत सूचना चाही गई है। प्राप्त ऑनलाइन आवेदन पत्र सम्बन्धित जनसूचना अधिकारी को अन्तरित किया जा चुका है। नियमानुसार निर्धारित अवधि में सूचना न प्राप्त होने /
सूचना से असंतुष्ट होने पर आवेदक द्वारा दिनांक
21.04.2024 को ऑनलाइन प्रथम अपील आवेदन किया गया, जिसके क्रम में ऑनलाइन प्राप्त प्रथम अपील की सुनवाई दिनांक
30.05.2024 को नियत करते हुए अपीलकर्ता को सुनवाई हेतु सूचना प्रेषित की गई। सुनवाई की नियत तिथि पर अपीलकर्ता उपस्थित नही हुए। सम्बन्धित जनसूचना अधिकारी /
उनके प्रतिनिधि उपस्थित हुए। सुनवाई के समय पत्रावली के परिशीलन से विदित हुआ कि अपीलार्थी को सूचना प्रेषित किये जाने का कोई अभिलेखीय साक्ष्य पत्रावली में उपलब्ध नहीं है।
अतः आदेशित किया जाता है कि श्री अतुल कृष्ण, उप सचिव /
ज०सू०अ० ल०वि०प्रा० इस आदेश के पारित होने के
15 दिवस के अन्दर आवेदक के ऑनलाइन आवेदन के सापेक्ष नियमानुसार प्रदाय किये जाने योग्य सूचनाएं स्पष्ट रूप से अपीलार्थी को उपलब्ध कराएं।
तद्नुसार प्रश्नगत ऑनलाइन प्रथम अपील निस्तारित की जाती है।

From the order passed by the first appellate authority
of the Lucknow Development Authority it is quite obvious that public
information officer deputy Secretary, Atul Krishna did not provide any
information to the appellant. Moreover, it is noticeable that no information
from public information officer is still received by the appellant. In view of the
appellant this is a historic denial of information by the public information
officer as he took under teeth whatever communications received in his office
under right to information.
Most surprising thing is that public information
officer deputy secretary Atul Krishna took under teeth the order passed by the
first appellate authority in the matter which is showing the wilful
disobedience of the provisions of right to information act by the public
information officer.
This is a humble request to the most respected sir
this is a fit case to impose pecuniary penalty under section 20 of the right to
information act 2005 on the public information officer so that such corrupt
practises may not set precedent for public authorities to withhold the
information with intention to conceal corruption.
The stand of the public information officer is not
only promoting the corruption in the department but also promoting indiscipline
in the office of the public authority because he repeatedly overlooked the
order passed by the first appellate authority in the various appeals.
This is a humble request of your appellant to you
Hon'ble Sir that how can it be justified to withhold public services
arbitrarily and promote anarchy, lawlessness, and chaos arbitrarily by making
the mockery of law of land? There is need of the hour to take harsh steps
against the wrongdoer to win the confidence of citizenry and strengthen the
democratic values for healthy and prosperous democracy. For this, your
appellant shall ever pray for you, Hon’ble Sir.
