Prayer- Public information officer did
not entertain RTI application within time 30 days as prescribed under
subsection 1 of section 7 of the right to information act 2005 and still they
have not provided any information. First appellate authority is having the same
treatment with the appeal submitted by the appellant.
Short submissions of the appellant
are as follows.
1-From the following status it is obvious
that nodal officer forwarded the matter to the public information officer of
Medical and Health Directorate on 23rd January 2024 and the appellant submitted
this application before the public information officer on 22nd January 2024
online through the rti portal of the government of Uttar Pradesh.
2-It is quite obvious that more than 5
months passed but concerned public information officer did not provide any
information to the appellant as well as he did not make any communication with
the appellant in order to provide the information to the appellant which is
violation of subsection one of section 7 of the right to information act 2005
so must be taken into account by the Most respected sir.

4-Right to
information act 2005 was introduced by government of India during the regime of
Congress to promote transparency and accountability in the working of public
authorities so that growing corruption in the working of public authorities
could be controlled till some extent but it seems that because of the anarchy
in the working of the public authorities and transparency ombudsman, no
information is being provided by the public information officers to the
information seekers which reflects the jungle rule in the state of Uttar
Pradesh.
5-CMS
District Women Hospital Mirzapur (Dr Sanjay Pandey) is not providing discharge
documents of Ruby W/O Pritesh Kumar.
The
information seeker is seeking information on behalf of Pritesh Kumar S/O
Lalchand resident of Danghar, Patharahia Road, Mirzapur City district-Mirzapur
PIN code 231001 as already several rti applications submitted to the public
authorities by aggrieved Pritesh Kumar, but concerned public information
officers are not providing any information to the person belonging to the
oppressed section of the society. For the details, please take a glance of the
attached document concerning deceased Rubi W/O Pritesh Kumar to the
application.
6-From the
following status it is quite obvious that the nodal officer of department of
medical and health transferred the RTI application of the appellant on 16th
October 2023 to chief medical superintendent women hospital district Mirzapur

7-This is a humble request of the
appellant to the most respected sir to Direct public information officer to provide
the information to the appellant at the earliest and initiate the disciplinary
proceedings and impose pecuniary penalty under section 20 of Right to
information act 2005 against the public information officer who is taking under
teeth the provisions of right to information act 2005.
8- The appellant sought
following information from the public information officer.
1-According to the
available X-Ray report, delivery was to take place in the month of June 2022
and your three doctors in the report found the patient in labour pain in the
beginning of the month of April 2022.
Please provide the test
carried out by the three doctors as mentioned in the report or any other thing
on which findings are based
2-Please provide the copy
of consent of the information seeker in which the information seeker opposed
the process of surgery so that the applicant may know when they managed to get
a sign of the applicant and how?
3-Please provide the
discharge report made on 16 April 2022 when patient was first discharged, and
time and name of staff carried out the process as well.
4-Please provide the time
when patient was readmitted and name of staff who processed it and time span
between discharge and readmission.
5- Please provide the
discharge report made on 16 April 2022 finally after the expiration of the
patient. After all it is obligatory duty of the caretakers of patients to take
discharge reports of the patients, but nothing was provided by the women-hospital
Mirzapur.
This is a humble request of your
applicant to you Hon'ble Sir that how can it be justified to withhold public
services arbitrarily and promote anarchy, lawlessness, and chaos arbitrarily by
making the mockery of law of land? There is need of the hour to take harsh
steps against the wrongdoer to win the confidence of citizenry and strengthen
the democratic values for healthy and prosperous democracy. For this, your
appellant shall ever pray for you, Hon’ble Sir.
