Grievance Description

The matter concerns the working of station house officer Drummond Ganj police station under the supervision of superintendent of police district-Mirzapur to register F.I.R. against offenders under sections 415, 468 420 195 and 471 of the Indian Penal Code who usurped the ancestral land of the applicant by reaping benefit of vulnerability of the applicant.

The details of offenders are as follows.

1- Dayashankar Mishra S/O Shambhu Saran Mishra, Police station-Drummond Ganj, village- Bhaisod Balay Pahad post-Drummond Ganj, tehsil-Lalganj, development block-Halia, District- Mirzapur Uttar Pradesh.

2- Hariprasad Mishra S/O Shambhu Saran Mishra,Police station-Drummond Ganj, village- Bhaisod Balay Pahad post-Drummond Ganj, tehsil-Lalganj, development block-Halia, District- Mirzapur Uttar Pradesh.

3- Lekhpal,Lalganj tehsil, 4- Revenue inspector, Lalganj tehsil and 5- Tehsildar, Lalganj tehsil

For the kind information of the investigation officer The applicant was the class one heir and property was to be transferred from grandfather to the applicant directly which was not done because of the rampant corruption in the working tehsil Lalganj. And facts were concealed by the concerned beneficiaries.

Cheating under IPC (Section 415):Cheating is considered a criminal offense under the Indian Penal Code, 1860 (IPC).Section 415 defines cheating as follows:Whoever, by deceiving any person, fraudulently or dishonestly induces that person to:Deliver any property to any person, or Consent that any person shall retain any property,Or intentionally induces the person so deceived to do or omit something they wouldn’t otherwise do or omit, and this act or omission causes or is likely to cause damage or harm to the body, mind, reputation, or property of deceived person, is said to have committed cheating.

It is quite obvious that station house officer Drummond Ganj district Mirzapur submitted arbitrary reports to close the following grievances without thinking about the pros and cons of the decision. The aplicant has already faced serious setback in the matter and now police have stood up in the row of offenders

Certainly! In the newly enacted Bharatiya Nyaya Sanhita (BNS), which replaces the Indian Penal Code (IPC), the section related to cheating has changed. Previously, Section 420 of the IPC defined cheating and led to the number 420 becoming a commonly used term for such crimes. However, in the BNS, this offense is now covered under Section 318. The BNS has a total of 358 sections, compared to the 511 in the IPC.

Report of police in Uttar Pradesh is never consistent with the submissions of the grievance submitted by the aggrieved due to lack of transparency and accountability in the working of the police. It is expected from the police that they must submit impartial report on the jansunwai portal but not possible because of the incredibility of the police in the state. The job of the police is to control the crime in the state and maintain the law and order but when the first information report of the citizens will not be registered by the police then crime will increase or decrease one can easily reply.
