चाही गई है। प्राप्त ऑनलाइन आवेदन पत्र सम्बन्धित जनसूचना अधिकारी को अन्तरित

किया जा चुका है। नियमानुसार निर्धारित अवधि में सूचना न प्राप्त होने / सूचना से

असंतुष्ट होने पर आवेदक द्वारा दिनांक 20.03.2024 को ऑनलाइन प्रथम अपील आवेदन

किया गया, जिसके क्रम में ऑनलाइन प्राप्त प्रथम अपील की सुनवाई दिनांक 30.05.

2024 को नियत करते हुए अपीलकर्ता को सुनवाई हेतु सूचना प्रेषित की गई। सुनवाई

की नियत तिथि पर अपीलकर्ता उपस्थित नही हुए। सम्बन्धित जनसूचना अधिकारी /

उनके प्रतिनिधि उपस्थित हुए। सुनवाई के समय पत्रावली के परिशीलन से विदित हुआ

कि अपीलार्थी को सूचना प्रेषित किये जाने का कोई अभिलेखीय साक्ष्य पत्रावली में

उपलब्ध नहीं है।

अतः आदेशित किया जाता है कि श्री अतुल कृष्ण, उपसचिव / ज०सू०अ० ल०वि०प्रा० इस आदेश के पारित होने के 15 दिवस के अन्दर आवेदक के ऑनलाइन आवेदन के सापेक्ष नियमानुसार प्रदाय किये जाने योग्य सूचनाएं स्पष्ट रूप से अपीलार्थी को उपलब्ध कराएं।

* Prayer or Relief Sought From the following status it is quite obvious that the appellant submitted the RTI application on 18th December 2023 which was forwarded to the concerned public information Officer on 19th December 2023. It is quite obvious that 3 months passed but concerned public information Officer did not entertain the RTI application of the appellant which is a mockery of the provisions of right to information act 2005. Right to information act 2005 was introduced by the government of India under the regime of Congress to promote transparency and accountability in the working of the public authorities. Consequently the rampant corruption in the government offices may be curbed if there will be transparency and accountability in the working of the government offices. It is a well known fact that 19 years passed but there is manifold increase in the corruption of the working of the public authorities under the Government of India and state governments which means the right to information act has failed to obtain its objective. In the concerned matter more than two dozen RTI applications have been submitted but it is most unfortunate public information Officer in Lucknow development authority did not entertain a single RTI application to provide information to the information seekers. The matter concerns the deep irregularity which had to be investigated by the Lucknow development authority but it is most unfortunate instead of serious investigation into the matter Lucknow development authority itself putting the entire matter of corruption under the carpet. Whether the deep irregularities in the working of the public authority can be concealed in the name of setting up a committee. It is quite obvious that public information Officer violated subsection 1 of section 7 of the right to information act 2005 according to which public information Officer has to provide information to information seekers within 30 days from the date of receipt of the application in the office of public authority but here 90 days passed but concerned public information Officer did not entertain the RTI application. The act of the public information Officer is tantamount to indiscipline which must be taken into account by the first appellate authority of the Lucknow development authority.
