अपीलार्थी श्री योगी एम०पी० सिंह पता मोहल्ला सुरेखापुरम, जबलपुर रोड, संघमोहाल पिन-231001 द्वारा दिनांक 23.01.2024 को सूचना का अधिकार अधिनियम-2005 की धारा-6 (1) के अन्तर्गत 01 बिन्दु पर ऑनलाइन सूचनायें आवेदित की गयीं। उक्त आवेदन दिनांक 21.01.2024 को सूचना धारक अधिकारी, उपसचिव, लखनऊ विकास प्राधिकरण को सूचना प्रदान करने हेतु अन्तरित किया गया। नियमानुसार निर्धारित अवधि में सूचना प्राप्त न होने पर अपीलार्थी द्वारा दिनांक 16.04.2024 को प्रथम अपील हेतु ऑनलाइन आवेदन किया गया, जिसके क्रम में प्रथम अपीलीय अधिकारी द्वारा ऑनलाइन प्रथम अपील की सुनवाई दिनांक 31.05.2024 नियत करते हुए अपीलकर्ता एवं जन सूचना अधिकारी, लखनऊ विकास प्राधिकरण को सुनवाई हेतु सूचना प्रेषित की गई।

सुनवाई की नियत तिथि 31.05.2024 पर अपीलार्थी श्री योगी एम०पी० सिंह नहीं उपस्थित हुए तथा सूचना धारक अधिकारी उपस्थित हुए। सुनवाई के समय पत्रावली के परिशीलन से विदित हुआ कि अपीलार्थी द्वारा मांगी गई सूचनायें विधि अनुभाग से सम्बन्धित हैं, जिस पर सूचना उपलब्ध नहीं करायी गयी है। आदेशित किया जाता है कि प्रभारी अधिकारी-विधि / जन सूचना अधिकारी इस आदेश के पारित होने

के 15 दिवस के अन्दर आवेदक के ऑनलाइन मूल आवेदन दिनांक 23.01.2024 के सापेक्ष नियमानुसार प्रदाय किये जाने योग्य सूचनायें / अभिलेख अपीलार्थी को उपलब्ध कराते हुए अवगत करायें, अन्यथा की स्थिति में वह उक्त अधिनियम के सुसंगत प्राविधानों के अन्तर्गत कोई विपरीत आदेश पारित होने के लिए उत्तरदायी होंगे।

तद्नुसार उक्त आदेश के साथ प्रश्नगत ऑनलाइन प्रथम अपील निस्तारित की जाती है।

* Prayer or Relief Sought From the following status of the RTI application, it is quite obvious that the appellant submitted the RTI application on 23rd January 2024 which was forwarded to the public information officer by the nodal officer of the public authority on the same date. It is most unfortunate that the concerned public information officer did not provide any information to the appellant. It is a mockery of the provisions of right to information act 2005. Right to information act 2005 was introduced by government of India during the regime of Congress to promote transparency and accountability in the working of public authorities but it seems that public authorities do not like to provide information to the information seekers because of the fear that they will be exposed in the public domain if such information will be accessible in the public. Whether in this way Lucknow Development Authority will curb the growing corruption in its working. It is quite obvious that numerous RTI applications submitted by the information seeker and the victim to know the status of the action taken by the chairman of the Lucknow Development Authority, but it is most unfortunate that public information officer is not disclosing any information under the right information act 2005 which is a mockery of the provisions of right to Information Act 2005. It seems that there is no rule of law in the working of the Lucknow Development Authority where such orders are taken under teeth because of the rampant corruption in the working of the public staff. Please direct the public information officer to provide information to the appellant as soon as possible in accordance with the law.
