Remarks :- Please refer to DOPT OM no. 10/2/2008-IR dated 12/06/2008, wherein it has been clarified that If a person makes an application to a public authority for some information which is the concern of a public authority under any State Government or the Union Territory Administration, the Central Public Information Officer (PIO) of the public authority receiving the application should inform the applicant that the information may be had from the concerned State Government/UT Administration. Application, in such a case, need not be transferred to the State Government/UT Administration. Moreover, the instructions on the home page of the portal clearly indicate viz. Please do not file RTI applications through this portal for the public authorities under the State Governments, including Govt. of Uttar Pradesh. If filed, the application would be returned, without refund of amount. Accordingly, your RTI application, which is the concern of a public authority under any State Government, is returned herewith. You may file the same before the concerned public authority under the State Government.

Short submissions of the appellant are as follows.

From the following submissions it is obvious that government order was also sent by department of administrative reform to the district magistrate Prayagraj to ensure compliance of G.O. by P.C.S. under his supervision and the appellant is seeking information concerning the compliance of the government order by the district magistrate Prayagraj, but it is most unfortunate concerned public information officer in the office of district Magistrate Prayagraj did not provide information to the appellant arbitrarily. The nodal officer did not adopt logistic approach to entertain the rti application and appeal. 

Sir, please refer to pages 4 and 5 of the PDF documents attached with this application. The government order was sent by Dhananjay Shukla, Special Secretary of the Government of Uttar Pradesh on 4th January 2024. This mandate is addressed to the Chairman Revenue Council Uttar Pradesh Lucknow, all Additional Chief Secretary, Principal Secretary Secretary, Government of Uttar Pradesh, all the heads of departments and chief office heads, Uttar Pradesh all the divisional commissioners of Uttar Pradesh, the District Magistrate of Uttar Pradesh. प्रेषक, धनन्जय शुक्ला, विशेष सचिव, उत्तर प्रदेश शासन।
