Grievance Description
The matter concerns land grabbing and repeated requests are being made by the applicants but senior superintendent of police district Badaun, Uttar Pradesh is not taking solid and strong action against the land grabbers. Dereliction of the Budaun police promoted the moral of the fenders and now they are only talking about such activities because of support of the police. The fault of the senior police officer in the district Budaun is that they are failed to fix the accountability of the subordinates. If the mockery of the law took place then it is obligatory duty of the concerned police to take action in the matter in order to maintain law order. Reluctant approach of the police in the matter reflects the failure of the law in the district Budaun which must be rectified through appropriate action.
Police are justifying the land grabbing in the name partition awaited between the applicant and offenders but factual position is that offenders are grabbing the land which was purchased by the applicant on 19 July 1985 which means 38 years ago quite obvious from scan copy papers of registry executed by registrar Raj Bahadur Saxena between the applicant who is purchaser and Kanhai Lal Sarin S/O Raj Bahadur Sarin who is the seller of the land.

The police submitted an arbitrary and inconsistent parrot report in the following grievance which is highly objectionable to the applicant. Concerned police may ask offenders to remove cars and other materials including construction work from the land of the applicant purchased from Kanhai Lal Sarin S/O Raj Bahadur Sarin whose measurement is 68 sq metres.The applicant has paid the price of the land and requisite fee to government for obtaining title of the land. How can partition claim of police in report be justified in the land of the applicant which is purchased land of the applicant.
The following grievance submitted by the husband of the applicant was arbitrarily disposed by concerned sub inspector and police officers by submitting inconsistent reports that the matter concerns the partition of the land which is quite wrong must be taken into account that this land was purchased by the husband of the applicant near about 40 years ago which registry was executed in the office of registrar on 19th July 1985. Which is attached as the last three pages of the attached PDF document to the grievance.

Which Canon law allows grabbing of the land by the litigant itself after filing litigation before the appropriate court and litigant is privileged and having immunity from the action of the police?
Undoubtedly the matter is sub judice but the act of the opposite party is of criminal nature which must be taken into account by the concerned police under the appropriate section of the Indian Penal Code.
Consequently F.I.R. must be registered against the opposition party including main conspirator Dinesh Gupta S/O R.D. Gupta and Shipra Gupta W/O Dinesh Gupta under the following sections of the Indian Penal Code. Section 441 (Criminal Trespass), Section 425 (Mischief), Section 420 (Cheating),Section 442 (House Trespass) and Section 503 (Criminal Intimidation) of the Indian penal code must be applied on the offenders.
Right to reason is the indispensable part of the sound administrative system so it is obligatory duty of the concerned police to provide the reason of not registering the first information report in the matter of land grabbing under the aforementioned sections of the Indian penal code.
