Grievance Description
The matter concerns the working of the district Magistrate Mirzapur who did not make compliance of the order passed by the Uttar Pradesh State Information Commission which is tantamount to indiscipline.
The matter concerns the non-compliance of the order passed by Uttar Pradesh state information commission in the matter appeal number-S-11-1410/C/2010, Registration number-233937.In this case/appeal the appellant was the applicant, and the opposite party was additional district magistrate land and revenue Mr Bansh Bahadur Singh District-Mirzapur.
Short submissions of the applicant are as follows.
1- The first page of the attached PDF document is the communication of the Registrar Uttar Pradesh State Information Commission addressed to the District Magistrate Mirzapur dated- 7th February 2024. Which is the reminder to make compliance of the order passed by the Uttar Pradesh state information commission.
2- The second page of the attached PDF document is the communication of the in charge of the penalty section of the Uttar Pradesh state information commission addressed to the Registrar Uttar Pradesh State Information Commission dated- 7th February 2024.
3- The third page of the attached PDF document is the communication of the Registrar Uttar Pradesh State Information Commission addressed to the District Magistrate Mirzapur dated 30th November 2018.4-The fourth page of the attached PDF document is the Order passed by the most respected member of the Uttar Pradesh state information commission Mr Gajendra Yadav in the appeal of the applicant.
5- From the third page of the attached pdf document it is quite obvious that concerned district magistrate had to make the compliance of the order passed by the Uttar Pradesh State Information Commission in the matter within three months from the date of receipt of the order of the respected commission.
6- It is submitted before the most respected Sir more than five years passed but the compliance of the order passed by the most respected Uttar Pradesh state information commission was not made by the district Majestic Mirzapur which reflects the rule of anarchy in the working of the district Magistrate.

D.M. is responsible for non-compliance of order passed by Uttar Pradesh state information commission for recovery of penalties. इसी प्रकार प्रत्येक मण्डलायुक्त एवं प्रत्येक जिलाधिकारी का यह दायित्व होगा कि उनके मण्डल अथवा उनके जनपद में नियुक्त किसी जन सूचना अधिकारी पर यदि उत्तर प्रदेश सूचना आयोग द्वारा अधिनियम की धारा-20 के अन्तर्गत अर्थदण्ड अधिरोपित किया जाता है तो वह अर्थदण्ड की वसूली उक्त जन सूचना अधिकारी के वेतन से कराएं। अर्थदण्ड वसूली के उपरान्त संबंधित नियंत्रक प्राधिकारी द्वारा इस सम्बन्ध में अनुपालन आख्या आयोग के रजिस्ट्रार को अविलम्ब प्रेषित की जाएगी। It is noticeable that compliance report has not been made available by the district magistrate to the state information commission government of Uttar Pradesh which is quite obvious from the reminder sent by the registrar of the Uttar Pradesh state information commission. What is the meaning of the order passed by the UPSIC if the penalties imposed by the UPSIC is not being recovered by the competent authorities?
