Prayer- Public information officer did not entertain RTI application within time 30 days as prescribed under subsection 1 of section 7 of the right to information act 2005 and thereafter he provided incomplete and misleading information.

Short submissions of the appellant are as follows.

Regarding the following six points, the public information officer made available information to the appellant through the personal secretary registrar of the Uttar Pradesh Information Commission as follows.

1-Public Information Officer may provide the initiatives of the Government of Uttar Pradesh to digitalize the inviting process of the second appeal for the compliance of order of the supreme court which means to provide the facilities of e-filing to the citizens in the state.

Information made available by PIO- E-filing facilities have been initiated in Uttar Pradesh information commission.

Submission- PIO could not disclose initiatives regarding the compliance of the order of the Supreme Court. It is noticeable that an objective cannot be an initiative. 

2-Public Information Officer must provide the detail of the proposal if any made on the part of the state government to digitalise the inviting process of the second appeal for the compliance of order of the supreme court.

Submission- Personal Secretary of the registrar denied this information as it was not concerned with his table.

3-Public Information Officer must provide the details of the proposal if any made on the part of the central government to digitalize the inviting process of the second appeal in the state of Uttar Pradesh as our great prime minister supports the digitization of the working of the public staff.

4-Public Information Officer may provide the information as to what are the difficulties being faced by the State Information Commission in digitizing the process of second appeal and why there is delay in its implementation? Please provide the details to the people in the state who are suffering a lot because of the offline mode and matter be informed to the apex court accordingly.

Information made available by PIO- E-filing facilities have been initiated in Uttar Pradesh information commission. Undoubtedly you did not delay in compliance with the order of the Supreme Court of India so this information is correct. 

 5-Public Information Officer must provide the fund details provided by the central government for the compliance of supreme court order if any.

 6-Public Information Officer must provide the fund details provided by the government of Uttar Pradesh for the compliance of order of the supreme court.

Submission of appellant-It is quite obvious that neither fund details nor processing of the implementation of the order was disclosed before the appellant. Chief Minister Office transferred rti application to department of administrative reform and Department of administrative reform to Uttar Pradesh Information Commission, but information denied on the ground that information does not concern with the table who provided information. The job to collect the information vested with the public information officer.

It is quite obvious that a website has been created and it is natural that a demand was made before the government thereafter fund is sanctioned and then it is released by the government and then website was created. It is quite explicit that this project is an outcome of the judgement passed by the most respected Supreme Court of India and when our learned judges were apprised of the fact that this project will need money which was the root cause they ordered the government to provide the fund necessary for the purpose. 

Right to information act was introduced by the government of India to promote transparency and accountability in the working of public authorities, but where is transparency and accountability?

This is a humble request of your applicant to you Hon'ble Sir that how can it be justified to withhold public services arbitrarily and promote anarchy, lawlessness, and chaos arbitrarily by making the mockery of law of land? There is need of the hour to take harsh steps against the wrongdoer to win the confidence of citizenry and strengthen the democratic values for healthy and prosperous democracy. For this, your appellant shall ever pray for you, Hon’ble Sir.
