The matter concerns the working of the senior superintendent of police District-Budaun and the applicant who is a senior citizen draws the kind attention of the Honourable Sir to matters that needs urgent action.

There are two types of evidence of corruption 1-direct evidence and 2-circumstantial evidence. Undoubtedly there is no direct evidence of corruption of police in the matter but circumstantial evidence itself stating that police provided the full support to the land grabbers which is the root cause the applicant is alleging that there is no impeccable integrity of the concerned police personnel in the matter because of they have adopted lackadaisical and partial approach in dealing with the matter which is quite obvious from there irresponsible and illogical reports submitted by them in dozens of grievances of the applicant on the public grievance portal at the Government of India. Instead of taking action against the offenders under sections Section 441 (Criminal Trespass), Section 425 (Mischief), Section420 (Cheating), 442 (House Trespass), Section 503 (Criminal Intimidation) of the Indian Penal Code, you have misused section 151 107 and 116 of the criminal procedure code which are preventive measures applied against the spirit of circular issued by D.G.P. office in compliance guidelines issued by High court of judicature at Allahabad to prevent misuse of preventive measures and such dereliction will only promote anarchy in the society and promote land grabbers.

Police are justifying the land grabbing in the name partition awaited between the applicant and offenders but factual position is that offenders are grabbing the land which was purchased by the applicant on 19 July 1985 which means 38 years ago quite obvious from scan copy papers of registry executed by registrar Raj Bahadur Saxena between the applicant who is purchaser and Kanhai Lal Sarin S/O Raj Bahadur Sarin who is the seller of the land. Please take a glance of the last five pages of the attached PDF document to the grievance. The police submitted an arbitrary and inconsistent parrot report in the following grievance which is highly objectionable to the applicant. Concerned police may ask offenders to remove cars and other materials including construction work from the land of the applicant purchased from Kanhai Lal Sarin S/O Raj Bahadur Sarin whose measurement is 68 sq. metres. The applicant has paid the price of the land and requisite fee to government for obtaining title of the land. How can partition claim of police in report be justified in the land of the applicant which is purchased land of the applicant. To curb the misuse of section 151/107/116 of criminal procedure code, the government of Uttar Pradesh in order to comply with the direction of the High court of judicature at Allahabad issued the circular dated 09 September 2021 attached as Page 1 of the attached PDF document. Form the contents of the aforementioned circular, it was directed to entire accountable staff of the department of police that powers provided to police officer under section 151/107/116 of the criminal penal code is discretionary power of police must be used with due caution otherwise pecuniary penalty of Rs.25000 may be imposed on the police if found guilty of the abusing the tools.

How can there be apprehension of a breach of peace because my son who is employed in a company and workplace is Gautam Buddh Nagar Noida? It is quite obvious that police are wreaking vengeance with the applicant because the applicant is submitting a grievance as police are adopting lackadaisical approach to take action against the offenders.

It is quite obvious that S.P. city district-Budaun, Uttar Pradesh Mr. Amit Kishore Srivastav in its report dated 7th September 2023 whatever report has been submitted same parrot report dated 11 December 2023 has been submitted in the following grievance with that report the applicant was not satisfied because that report was inconsistent and arbitrary and submitted by him without taking the perusal after contents of the grievance. Which Canon law allows grabbing of the land by the litigant itself after filing litigation before the appropriate court and litigant is privileged and having immunity from the action of the police? Undoubtedly the matter is sub judice but the act of the opposite party is of criminal nature which must be taken into account by the concerned police under the appropriate section of the Indian Penal Code. Consequently F.I.R. must be registered against the opposition party

The matter concerns Budaun police, district-Budaun, Uttar Pradesh. Police is adopting a lackadaisical approach in the matter of land grabbing in which adjudication is pending before the court of law. Police are escaping from the matter on the flimsy ground which will promote the anti-social elements to keep on their illegal activities. There is no fear of police action in the offenders because of lackadaisical approach of police and partial cryptic reports of police on the Jansunwai portal.

Most respected Sir, how can police escape from the matter merely on the ground that the matter is of civil nature. If the police themselves accept that the matter is sub judice in various courts, then which competent court or magistrate provided them permission of construction and other activities in the land whose title is sub judice before the court? How to install a submersible pump in the land and grab it in a cryptic and mysterious way may be justified? Whether the act of the opposite party is not tantamount to house trespass and this land grabbing even when matter is pending before the court is not punishable under the various sections of the Indian Penal Code? Whether the opposite party is not superseding the court order because adjudication is pending before the various Court of Justice. Honourable Sir it is obligatory duty of the police to maintain the status quo of the impugned land but police have failed because of the partial approach in the matter.

In the report submitted by the Superintendent of police Budaun city it is quite obvious that in the concerned matter, the adjudication is pending before the court moreover this litigation has been submitted by the opposite party for seeking justice however opposite party itself having no regard for the adjudication awaited from the respected court of law.

The applicant is making inquiry under Article 51 A of the constitution of India to the senior Superintendent of police district-Budaun under whose supervision this anarchy is taking place.

1-It is quite from the attached reports of the police that information seeker submitted repeated representations before Budaun police, but police did not register first information report in the matter of land grabbing by taking recourse that adjudication is pending in the court regarding the matter.

Please provide the canon law which allows the litigant to grab the land which adjudication is pending in the court of law.

2-Please provide the order of the competent court which allowed Dinesh Kumar Gupta S/O Ram Bahadur Gupta to grab the land of the information seeker.

3-Concerned police must provide the efforts made by it to remove the encroachment made by Dinesh Kumar Gupta S/O Ram Bahadur Gupta in the land of the information seeker.
