* Prayer or Relief Sought 1-It is quite from the attached reports of the police that the information seeker submitted repeated representations before Budaun police, but police did not register a first information report in the matter of land grabbing by taking recourse that adjudication is pending in the court regarding the matter.

Please provide the canon law which allows the litigant to grab the land which adjudication is pending in the court of law.

Submission of the appellant- Under this point the public information officer is saying that adjudication concerning the partition and possession is pending in the competent court. This information is misleading because property grabbed by the offender is the purchased property of the applicant Vimal Kumar Rastogi from somebody else which is not the part of partition.

2-Please provide the order of the competent court which allowed Dinesh Kumar Gupta S/O Ram Bahadur Gupta to grab the land of the information seeker.

Submission of the appellant - This information is also misleading because the appellant is seeking order of the magistrate but you have provided the description of various cases to mislead the appellant instead of the order of the competent court.

3-Concerned police must provide the efforts made by it to remove the encroachment made by Dinesh Kumar Gupta S/O Ram Bahadur Gupta in the land of the information seeker.

Submission of the appellant- Whether the offenders had the order of the court to grab the land of the information seeker Vimal Kumar Rastogi. Moreover this land was registered in the name of the information seeker 35 years ago through the appropriate procedure before the registrar. Here police had to remove the encroachment because this encroachment by the offenders is illegal.

4-Kotwali police says that the information seeker and his family members are fugitive as told by few people even Kotwal said it publicly.

Please provide the court proceedings in detail to the information seeker which was not attended by the information seeker and his family members.

Submission of the appellant- For your kind information the appellant and his wife were present in the court of the District Judge already in the revision which was under consideration before the District Judge against the said matter. How can the appellant and his family members be fugitives? The kotwal maligned our image publicly and defamed us which is against the dignity of the police. .

5-Please provide the code of conduct for police which allows them to act like rumour mongers against senior citizens husband and wife who are living with his son because the protection could not be provided by the police even after repeated requests. Police ignore the offenses the offenders in the name of adjudication are pending which promoted the offenders creating danger to the security.

Submission of the appellant- the appellant is seeking the code of conduct for police which allows the police to act like rumour mongers which was not provided but they have misled the appellant that they are providing security to every senior citizen but the fact is that the appellant and his wife are living in Noida due to the security reasons.
