The appellant sought following
information from the public information officer.
1- Public information officer may
provide the name and designation of the staff who are processing the following
email sent to the public authority by the information seeker. to:
sp-cyber.lu@up.gov.in date: 2 Sept 2023, 09:57Provided information- The report
has been sent already to the cyber cell regarding the aforementioned
representation by the investigation officer.
Submission- The
appellant is seeking the name and designation of the staff processing the email
application to: sp-cyber.lu@up.gov.in date: 2 Sept 2023, 09:57.
2- Public information officer may provide the minutes of the proceedings made by the public authority regarding the following email. Provided information- The aforementioned information is concerned with the cyber cell Lucknow.
Submission- If the information is concerned with the cyber cell luck then it had to be transferred to the cyber cell Lucknow under subsection 3 of section 6 of the right to information act 2005 but it was not done.
3- Public information officer may provide the noting made by the accountable official of the public authority endorsing the following email and the action consequently, also provide next proceeding made in the matter. Provided information- The aforementioned information is concerned with the cyber cell Lucknow.
Submission- If the
information is concerned with the cyber cell luck then it had to be transferred
to the cyber cell Lucknow under subsection 3 of section 6 of the right to
information act 2005 but it was not done.
4- Public information officer may provide the action details taken by the public authority regarding the email of this information seeker. This information was denied by the public information officer by taking the recourse of subsection 1J of section 8 of the right to information act 2005 illegally.Subsection1(j) of Section 8 of the right to information act 2005 states that information which relates to personal information the disclosure of which has not relationship to any public activity or interest, or which would cause unwarranted invasion of the privacy of the individual unless the Central Public Information Officer or the State Public Information Officer or the appellate authority, as the case may be, is satisfied that the larger public interest justifies the disclosure of such information: Provided that the information, which cannot be denied to the Parliament or a State Legislature shall not be denied to any person.
5- Public information officer may provide the copy of the documents exchanged by the public authority with the local office of the anti-cyber-crime in the district Mirzapur.
This information was also denied by the public information officer by taking the recourse of subsection 1J of section 8 of the right to information act 2005 illegally.
How can information concerning the
working of the public authority be the personal information of anyone and this
information has been sought by the information seeker on behalf of aggrieved
applicant under his permission so denial of information by the public
information officer is arbitrary and sowing his insolence to the provisions of
right to information act 2005?
This is a humble request of your applicant to you Hon'ble Sir that how can it be justified to withhold public services arbitrarily and promote anarchy, lawlessness, and chaos arbitrarily by making the mockery of law of land? There is need of the hour to take harsh steps against the wrongdoer to win the confidence of citizenry and strengthen the democratic values for healthy and prosperous democracy. For this, your appellant shall ever pray for you, Hon’ble Sir.
