Concerned police submitted arbitrary and inconsistent report in the following grievance and whatever report has been submitted by the police concerning the assault on the applicant by the offenders. It is noticeable that the current matter concerns the grabbing of the land which adjudication is pending before the court of the law which is self-obvious from the report of the police submitted in the earlier grievances and in this grievance also. The offenders are doing construction quite obvious from the attached photographs to the grievance so please act instead of overlooking the matter by submitting inconsistent and arbitrary reports in the matter.

It is quite obvious that the applicant has attached the sequence of photographs of the construction and encroachment done by the offenders which must be considered by the concerned sub inspector and the Kotwal of the Kotwali under whose signature the partial report submitted on the public grievance portal by the police of the district Budaun. In this sequence of photographs there are 30 pictures which are showing, how the construction took place under the monitoring of the offenders? It is noticeable that video of the construction watch provided by the aggrieved applicant on the WhatsApp of the concerned sub inspector who was investigating the matter whose name is Anil Kumar Rana designation-sub inspector cum in-charge.

Budaun police is not registering F.I.R. of senior citizen in matter of land grabbing and overlooked repeated complaints of the applicant Vimal Kumar Rastogi.

Whether the pending adjudications in civil matters provide immunity to defenders from registering criminal cases against them. Whether such lackadaisical approach of the police in dealing with the criminal matters will not promote criminal activities in the society ipso facto police is overlooking the matter on the flimsy ground only promoting offenders. Here this question arises that why is the police is sympathetic to the offenders instead of senior citizen who is the victim in the crime committed by the offenders?

Under Article 51 A of the constitution of India the applicant who is a senior citizen making following enquiries to the concerned investigation officer who is also the in charge of the Kotwali named Anil Kumar Rana. The applicant has full faith that he will not respond following queries properly as usual done by the concerned police.

1-It is quite from the attached reports of the police that information seeker submitted repeated representations before Budaun police, but police did not register first information report in the matter of land grabbing by taking recourse that adjudication is pending in the court regarding the matter.

Please provide the canon law which allows the litigant to grab the land which adjudication is pending in the court of law.

2-Please provide the order of the competent court which allowed Dinesh Kumar Gupta S/O Ram Bahadur Gupta to grab the land of the information seeker.

3-Concerned police must provide the efforts made by it to remove the encroachment made by Dinesh Kumar Gupta S/O Ram Bahadur Gupta in the land of the information seeker.

4-Kotwali police says that the information seeker and his family members are fugitive as told by few people even Kotwal said it publicly.

Please provide the court proceedings in detail to the information seeker which was not attended by the information seeker and his family members.

5-Please provide the code of conduct for police which allows it to act like rumour mongers against senior citizens husband and wife who are living with his son because of the protection could not be provided by the police even after repeated requests. Police ignores the offenses the offenders in the name of adjudication are pending which promoted

Grievance Description-The matter concerns Budaun police, district-Budaun, Uttar Pradesh. Police is adopting a lackadaisical approach in the matter of land grabbing in which adjudication is pending before the court of law.

Police are escaping from the matter on the flimsy ground which will promote the anti-social elements to keep on their illegal activities.

Most respected Sir, how can police escape from the matter merely on the ground that the matter is of civil nature and police itself accept that the matter is sub judice in various courts. Which competent court or magistrate provided them permission in the land which is sub judice before the court to install a submersible pump and grab it in a cryptic and mysterious way? Whether the act of the opposite party is not tantamount to house trespass and this land grabbing even when matter is pending before the court is not punishable under the various sections of the Indian Penal Code? Whether the opposite party is not superseding the court order because adjudication is pending before the various Court of Justice. Honourable Sir it is obligatory duty of the police to maintain the status quo of the impugned land but police have failed because of the partial approach in the matter.

In the report submitted by the Superintendent of police Budaun city it is quite obvious that in the concerned matter adjudication is pending before the court moreover this litigation has been submitted by the opposite party for seeking justice however the opposite party itself having no regard for the adjudication awaited from the respected court of law.

Which Canon law allows grabbing of the land by the litigant itself after filing litigation before the appropriate court and the litigant is privileged and having immunity from the action of the police?

Undoubtedly the matter is sub judice but the act of the opposite party is of criminal nature which must be taken into account by the concerned police under the appropriate section of the Indian Penal Code.

Consequently F.I.R. must be registered against the opposition party including main conspirator Dinesh Gupta S/O R.D. Gupta and Shipra Gupta W/O Dinesh Gupta under the following sections of the Indian Penal Code.

Section 441 (Criminal Trespass): When someone unlawfully enters a property, or lawfully enters a property but unlawfully remains there (such as a tenant after expiration of tenancy) with the intent to commit an offence, or to intimidate, insult or annoy the person in possession of such property, it amounts to criminal trespass.

Section 425 (Mischief): When someone intentionally or knowingly causes destruction of a property or any change in a property that diminishes its value or utility, they are said to commit mischief.

Section 420 (Cheating): This provision is applied when someone cheats and deceives you into delivering any property to someone else.

Section 442 (House Trespass): This is a form of “criminal trespass” wherein the trespasser unlawfully enters a human dwelling, or any building used as a place of worship

Section 503 (Criminal Intimidation): Any threat of injury to person, reputation or property

अधीनस्थ अधिकारी के स्तर पर निस्तारित श्रीमान जी संलग्न शिकायती प्रार्थना पत्र के सम्बन्ध में जाँच आख्या अवलोकनार्थ सादर सेवा में प्रेषित है श्रीमान जी उक्त प्रकरण की जांच मुझ प्रभारी निरीक्षक मय उ0नि0 अनिल कुमार राणा के की गयी तो तो वाक्यात इस प्रकार पाये गये कि आवेदक नोयडा में अपने बेटे व पत्नी के साथ रहता है उनका कहना है कि जनपद बदायूं स्थित घर के सामने पडे प्लाट में विपक्षी द्वारा कब्जा करने का प्रयास करने के उद्देश्य से समरसेबल लगा लिया है तथा उक्त आवेदक मकान के सामने पडी जमीन पर निर्माण करने से रोका गया है और बिखरी पडी ईटो को अपने मकान के सामने रख लेना बताया और माननीय न्यायालय में परेशान करने की नियत से विभिन्न वाद आवेदक के खिलाफ दायर कर दिये है प्रकरण के सम्बन्ध में जांच से पाया कि आवेदक विमल कुमार व उसके सगे भाई स्व0 अशोक कुमार रस्तोगी के सामने खाली जगह है जिसे आवेदक अपनी बताता है और स्व0 अशोक कुमार रस्तोगी की पत्नी किरन रस्तोगी अपनी बताती है आवेदक के भाई स्व0 अशोक कुमार रस्तोगी के कोई पुत्र न होने के कारण उनकी पुत्री क्षिप्रा रस्तोगी अपने पति दिनेश कुमार गुप्ता पुत्र श्री आरबी गुप्ता के साथ अपने पिता के हिस्से के मकान में रहती है मकान के सामने पडी जगह को दोनो पक्ष अपनी अपनी बताते है पडी जगह का दोनो पक्षो के मध्य बटवारा नही हुआ है आवेदक अपने लडके के पास नोयडा में रहते है कभी कभी बदायूं आते है तथा विपक्षी क्षिप्रा रस्तोगी आपनी मां के साथ उक्त मकान में अपने पति के साथ रहती है जिसके दरवाजे के आगे दोनो पक्षो की खाली जमीन है जिसमे से आने जाने का रास्ता है विगत वर्ष उक्त खाली पडी जमीन में आवेदक व उसके परिजन द्वारा ईटे निर्माण कार्य हेतु मगायी जिस पर दोनो पक्षो में अपनी अपनी बताने को लेकर कहासुनी हुई और निर्माण नही हो पाया जिसके बटवारे के सम्बन्ध में श्रीमती किरन रस्तोगी ने वाद सं0 214.22 किरन रस्तोगी बनाम विमल रस्तोगी माननीय न्यायालय मे दायर किया जो विचाराधीन है उक्त पक्षो के मध्य सम्पत्ति के विवाद को लेकर विभिन्न न्यायालयो में वाद सं0 233.22 ,वाद सं0 1103.23 दिनेश गुप्ता बनाम विमल रस्तोगी ,190.23 विमल रस्तोगी बनाम दिनेश रस्तोगी ,134.22 किरन रस्तोगी बनाम राहुल रस्तोगी ,184.22 किरन रस्तोगी बनाम विमल रस्तोगी आदि भिन्न भिन्न न्यायालय में विचाराधीन होना ज्ञात हुए है उल
