If entire payment made before registry of land then why the payment made through bank after registry of land, so investigation officer is wrong who is taking recourse of registry papers in submitting report to justify opposite party cryptically.

It is quite obvious that concerned investigation officer of police submitted arbitrary and inconsistent report in the matter and close the following grievance arbitrarily without looking into the fact after case which is a matter of great concern for the applicant. Investigation officer of the police should know that during the process of the registry of the land facts are not authenticated by the competent officers if any problems subsequently arise then competent authority dispose of them which is the root cause of huge pending backlog of cases is in the revenue courts.

Grievance Description-The matter concerns the working of the superintendent of police district Mirzapur and it is a special request of a senior citizen to provide him justice by adopting a Logistic approach in the matter. There is no transparency and accountability in the investigation of the investigation officer, quite obvious from the cryptic and mysterious approach of the investigation officer since the beginning which is condemnable.

Let the investigation officer tell the application whether the payment of the land was made by the purchaser to the applicant before the execution of the registry or after the execution of the registry. There is no doubt in it that the payment of the price of the land was made by the purchaser after the execution of the registry of the land which means formalities performed during the registry of the land was the mutual consent between the parties for the smooth flow of the official work.

It is quite obvious that investigation of the police is not focused on the allegations of the applicant but it is centralised on the nullification of the allegations through its bogus reports which are not relevant into the matter so it is humble request of the senior citizen that police must be instrumental in finding the facts of the case and providing rest of the price of the land to the applicant through the purchaser of the land.

If the competent accountable officer of the police who are accepting the arbitrary and inconsistent report of the investigation officer of the police might ask the investigation officer to provide the transaction details made by the purchaser of the land then it may be proved that whatever mentioned in the registry paper is not true otherwise why did the purchaser pay the price of the land after the execution of the registry of the land?

The matter concerns cheating with a senior citizen and criminal breach of trust which was made between the parties orally, but it is most unfortunate that the investigation officer is adopting a lackadaisical approach in the matter to provide justice to a senior citizen. As far as section 107 and 116 of The Criminal Procedure Code were only misused to divert the attention of the applicant because these are preventive measures which are used to prevent the crimes not In those cases were crimes have been committed by the offenders. Felling of green trees concerns the working of the Department of Forest, and the applicant has made the complaint to the concerned department which is pending at the level of the director of the Department of Forest dealing with the environmental issues.

Sir, it is clear that whatever payment has been made to the applicant by the opposite party, has been done through the bank and payment done after execution of registry and that is clear from transaction details. Sir, if the police investigated the land sold at the local level and whatever has been paid to the applicant is the fair price of the land,

Grievance Description-Sir, it is clear that whatever payment has been made to the applicant by the opposite party, has been done through the bank and payment done after execution of registry and that is clear from transaction details. Sir, if the police investigated the land sold at the local level and whatever has been paid to the applicant is the fair price of the land, then the whole matter would have been clear like a mirror. Sir, it is true that the applicant is an 80-years-old man, so it cannot be expected that the applicant can force whatever price was fixed to be paid after the registry which is quite obvious from bank transactions. Whether Sub-Inspector will tell the applicant what is the fair price of the land, his report is partial and in the interest of the opposition because before him the opposition admitted that they have cut the mango tree and was paying Rs.3000 for it as compensation but he denied in his report cutting of green mango tree reflects his partiality.

प्रकरण में सम्बंधित से आख्या प्राप्त कर निस्तारण हेतु प्रेषित है आख्या संलग्न है आख्या अवलोकनार्थ सादर सेवा में प्रेषित है संदर्भित प्रकरण मे गहराई से जॉच किया गया तथा प्रभारी निरीक्षक विन्ध्याचल से आख्या प्राप्त किया गया तो पाया गया कि आवेदक उपरोक्त पते का निवासी है जॉच से ज्ञात हुआ कि आवेदक द्वारा वर्ष 2016 मे अपनी अराजी संख्या588,556,564,586 मौजा नौगांव कुल 04 नम्बरों मे मुताबिक हिस्सा कुल 04 विश्वा 10 धुर जमीन विपक्षी जमीन विनोद तिवारी पत्नी सीमा तिवारी के नाम रजिस्ट्री बैनामा किया था जिसकी कीमत मुताबिक रजिस्ट्री पेपर रजिस्टार न्यायालय मे दर्शाया गया है तथा रजिस्ट्री पेपर विक्रय विलेख मे कोई बकाया धन अंकित नही श्रीमान् जी आख्या संलंग्न है
