Theft of Electricity
Section 135 sets out elaborately what is theft of electricity and what actions would indicate theft. Anybody who dishonestly taps or makes a connection with any line or cable (overhead, underground or underwater) or service line or service facility of a licensee in order to abstract, consume or use electricity is considered to have committed an offence of ‘theft of electricity.’ Anybody who tampers with an electric meter or uses a tampered meter or any other devise or method which interferes with accurate metering of electric current for personal or corporate gains is liable for an offence of theft of electricity. Further, anybody who damages or destroys an electric meter or uses electricity through a tampered meter or uses electricity for any other purpose other than for which, usage of electricity was authorised is deemed to have committed theft of electricity.
Section 135 further stipulates that anybody found guilty of theft of electricity is liable for imprisonment of up to three years, or fine or both

Grievance Description

The matter concerns working of Police Enforcement Team, Mirzapur i.e. S.H.O. anti-power theft police station District-Mirzapur as told Exen EDD II .

After investigation, irregularities related to electricity theft were found on the premises of the complainant, in the wake of which an FIR has been lodged by the Police Enforcement Team whence Concerned investigation officer may provide the status of investigation. 

The matter concerns executive engineer electricity distribution division second, Mr Rajesh Kumar, Fatha, District-Mirzapur and S.H.O. anti-power theft police station District-Mirzapur. Executive engineer EDD II Mirzapur may provide status of the recovery rupees Rs.2,17,746.00 from Dileep Singh S/O Raghuvar Dayal Singh resident of village Kothra Kantit post Srinivas Dham district Mirzapur.. 

After investigation, irregularities related to electricity theft were found on the premises of the complainant, in the wake of which an FIR has been lodged by the Police Enforcement Team, Mirzapur under Section 135 of the Indian Electricity Act 2003 at the Anti-Power Theft Police Station, Police Station - Mirzapur. Concerned investigation officer may provide the status of investigation. 

An application under Article 51 A of the constitution of India to make inquiry regarding the recovery of the Electricity duty and penalty imposed on the Dileep Singh S/O Raghuvar Dayal Singh which is quite obvious from the communication exchanged from the executive engineer electricity distribution division second Mr Rajesh Kumar attached to the grievance.

Short submissions of the applicant are as follows.

1-Think about the gravity of the situation, theft of electricity was caught red handed in the premises being done by Dileep Singh on 2nd September 2021. Whether the department is not adopting a lackadaisical approach in the recovery of electricity charges and penalties imposed.

2-I do not think that there is any loss if the recovery of the electricity charges and imposed penalties is carried out from Dileep Singh son of Raghuvar Dayal Singh by the Department of electricity . Procrastination on the part of the department is only showing the dereliction of the duty of the concerned accountable staff.

3-If the matter becomes old then its importance lowers down so it is a humble request of the applicant to take action in the matter with dedication to the duty so that recovery may be carried out smoothly.

After investigation, irregularities related to electricity theft were found on the premises of the complainant, in the wake of which an FIR has been lodged by the Police Enforcement Team, Mirzapur under Section 135 of the Indian Electricity Act 2003 at the Anti-Power Theft Police Station, Police Station - Mirzapur.

In the matter, revenue as electricity fee to be charged from Dileep Singh Rs.187746.00 decided provisionally and its recovery fee Rs.30000 thus total collection of revenue to be realised from Dileep Singh S/O Raghuvar Dayal Singh is Rs.217746.00.

  1. Section 135 is being blatantly misused by the personnel of Uttar Pradesh Power corporation limited in the district Mirzapur. It is most unfortunate government of Uttar Pradesh is adopting lackadaisical approach in the matter.

Undoubtedly it is reflecting the deep rotate corruption in the working of the department of electricity district Mirzapur but it is most unfortunate no action is being taken against the corruption in the departments by Yogi Adityanath government. Think about the gravity of situation when the repeated requests are being made by the aggrieved applicant but no recovery was made from the people who were indulged in the theft of electricity.
