Grievance Description

To curb the misuse of section 151/107/116 of criminal procedure code, the government of Uttar Pradesh in order to comply with the direction of the High court of judicature at Allahabad issued the circular dated 09 September 2021 attached as Page 1 of the attached PDF document. Form the contents of the aforementioned circular, it was directed to entire accountable staff of the department of police that powers provided to police officer under section 151/107/116 of the criminal penal code is discretionary power of police must be used with due caution otherwise pecuniary penalty of Rs.25000 may be imposed on the police if found guilty of the abusing the tools. 

How can there be apprehension of a breach of peace because my son who is employed in a company and workplace is Gautam Buddh Nagar Noida? It is quite obvious that police are wreaking vengeance with the applicant because the applicant is submitting a grievance as police are adopting lackadaisical approach to take action against the offenders. 

Police are justifying the land grabbing in the name partition awaited between the applicant and offenders but factual position is that offenders are grabbing the land which was purchased by the applicant on 19 July 1985 which means 38 years ago quite obvious from scan copy papers of registry executed by registrar Raj Bahadur Saxena between the applicant who is purchaser and Kanhai Lal Sarin S/O Raj Bahadur Sarin who is the seller of the land. Please take a glance of the last five pages of the attached PDF document to the grievance. The police submitted an arbitrary and inconsistent parrot report in the following grievance which is highly objectionable to the applicant. Concerned police may ask offenders to remove cars and other materials including construction work from the land of the applicant purchased from Kanhai Lal Sarin S/O Raj Bahadur Sarin whose measurement is 68 sq metres.The applicant has paid the price of the land and requisite fee to government for obtaining title of the land. How can partition claim of police in report be justified in the land of the applicant which is purchased land of the applicant. Grievance Description-Concerned police submitted arbitrary and inconsistent reports in the following grievance and whatever report has been submitted by the police concerning the assault on the applicant by the offenders. It is noticeable that the current matter concerns the grabbing of the land which adjudication is pending before the court of the law which is self-obvious from the report of the police submitted in the earlier grievances and in this grievance also. The offenders are doing construction quite obvious from the attached photographs to the grievance so please act instead of overlooking the matter by submitting inconsistent and arbitrary reports in the matter.

Under Article 51 A of the constitution of India the applicant who is a senior citizen making following enquiries to the concerned investigation officer who is also the in charge of the Kotwali named Anil Kumar Rana. The applicant has full faith that he will not respond following queries properly as usual done by the concerned police.

1-It is quite from the attached reports of the police that the information seeker submitted repeated representations before Budaun police, but police did not register first information report in the matter of land grabbing by taking recourse that adjudication is pending in the court regarding the matter.

Please provide the canon law which allows the litigant to grab the land which adjudication is pending in the court of law.

2-Please provide the order of the competent court which allowed Dinesh Kumar Gupta S/O Ram Bahadur Gupta to grab the land of the information seeker.

Please remove encroachment otherwise register FIR.

3-Concerned police must provide the efforts made by it to remove the encroachment made by Dinesh Kumar Gupta S/O Ram Bahadur Gupta in the land of the information seeker.

4-Kotwali police says that the information seeker and his family members are fugitive as told by few people even Kotwal said it publicly.

Please provide the court proceedings in detail to the information seeker which was not attended by the information seeker and his family members.

5-Please provide the code of conduct for police which allows them to act like rumour mongers against senior citizens husband and wife who are living with his son because protection could not be provided by the police even after repeated requests. Police ignores the offenses the offenders in the name of adjudication are pending which promoted anarchy.

It is quite obvious that the applicant has attached the sequence of photographs of the construction and encroachment done by the offenders which must be considered by the concerned sub inspector and the Kotwal of the Kotwali under whose signature the partial report submitted on the public grievance portal by the police of the district Budaun. In this sequence of photographs there are 30 pictures which are showing, how the construction took place under the monitoring of the offenders? It is noticeable that video of the construction watch provided by the aggrieved applicant on the WhatsApp of the concerned sub inspector who was investigating the matter whose name is Anil Kumar Rana designation-sub inspector cum in-charge.

Budaun police is not registering F.I.R. of senior citizen in matter of land grabbing and overlooked repeated complaints of the applicant Vimal Kumar Rastogi.

Whether the pending adjudications in civil matters provide immunity to defenders from registering criminal cases against them. Whether such lackadaisical approach of the police in dealing with the criminal matters will not promote criminal activities in the society ipso facto police is overlooking the matter on the flimsy ground only promoting offenders. Here this question arises that why is the police is sympathetic to the offenders instead of senior citizen who is the victim in the crime committed by the offenders?
