Superintendent of S.R.N. Bhadohi, Uttar Pradesh may take cognizance of land grabbing by offenders. S.H.O. Chauri implicated the late father of the victim in the matter of land grabbing however the next question is -how will police summon him for bond?

Most respected sir with this grievance report of the circle officer Aurai Dr. Umeshwar Prabhat Singh and investigation officer Rameshwar Nath Yadav police station Chauri is attached in both reports name of the offenders are changed. It is most unfortunate that in the report of investigation officer, Rameshwar Nath Yadav, police station Chauri not a single individual from the offenders were named, most surprising name of the late father Vakil Dhar Tiwari of the applicant is included in the name of the offenders which reflects the incredibility of the report of the investigation officer. Prime offender of the land grabbing is Tej Dhar Tiwari S/O Ram Chandra Tiwari not included in any list of the police is a matter of concern showing partial and corrupt dealings of the police.

The real offenders belonging to the opposition party indulged in the land grabbing of the applicant are as follows.

1-Tej Dhar Tiwari S/O Ram Chandra, Prime accused and master mind of the land grabbing.

2-Ashutosh Tripathi S/O Rajesh Tripathi

3-Pradeep Tiwari S/O Tej Dhar Tiwari

4-Shubham Tiwari S/O Pradeep Tiwari

The matter concerns the arbitrary and inconsistent reports repeatedly submitted by the in-charge of the Chauri bazar police station and the report of concerned circle officer itself contradictory to the report of the investigation officer regarding the details of the offenders.

If the viewpoints and false submissions of the first offender Tej Dhar Tiwari S/O Ram Chandra, Prime accused and master mind of the land grabbing maybe accepted by the public staff then the applicant and his brothers will have to leave the village because houses constructed by the applicant and his brothers in the village-Kandui belongs to the prime offender Tej Dhar Tiwari S/O Ram Chandra and applicant and his brothers must leave the paternal village because having no belongings quite obvious from his submissions submitted before the civil judge senior division attached as the page 4, 5 and 6 of the PDF documents to the grievance.

In this matter police have two options, one of them is to provide the copy after order of the competent authority so that the applicant may challenge it to the proper court and the second option is to register the case against the offenders under the following sections of the Indian Penal Code.

Section 441 (Criminal Trespass): When someone unlawfully enters a property, or lawfully enters a property but unlawfully remains there (such as a tenant after expiration of tenancy) with the intent to commit an offence, or to intimidate, insult or annoy the person in possession of such property, it amounts to criminal trespass. Section 425 (Mischief): When someone intentionally or knowingly causes destruction of a property or any change in a property that diminishes its value or utility, they are said to commit “mischief”. Section420 (Cheating): This provision is applied when someone cheats and deceives you into delivering any property to someone else. #Section 442 (House Trespass):This is a form of “criminal trespass” wherein the trespasser unlawfully enters a human dwelling, or any building used as a place of worship or as place for the custody of property. Section 503 (Criminal Intimidation): Any threat of injury to person, reputation or property with the intent to cause them to do something which they are not legally bound to do is a form of “criminal intimidation”. This is a humble request of your applicant to you Hon'ble Sir that It can never be justified to overlook the rights of the citizenry by delivering services in an arbitrary manner by floating all set up norms. This is sheer mismanagement which is encouraging wrongdoers for crimes and promoting criminal activities in the society.
