For the more details please take a glance of the 4th page of the attached PDF document to the appeal which is communication of the nodal public information officer in the office of the managing director of the Purvanchal Vidyut Vitran Nigam limited dated 11th July 2023 which is addressed to the chief engineer Mirzapur division.

After checking, irregularities concerning the theft of electricity was uncovered in the premises of the complainant. In that perspective vigilance team of police registered a first information report in the anti-power theft police station Mirzapur under section 135 the Indian electricity act 2003. This feedback was made available to the appellant by the executive engineer electricity distribution division second Mr Rajesh Kumar. The appellant had sought following information from the public information officer regarding the aforementioned matter.

1-Copy of the first information report was sought from the vigilance team of police Mirzapur. 

2-If the vigilance team have submitted the chargesheet in the matter then provide the copy of the charge feet and the date when the charge sheet was submitted.

3-Provide the posting details, designation and name of the investigation officer in the aforementioned matter.

4-Provide the current status of the action being taken by the vigilance team of the police in the matter. 

5-Provide the number of actions taken by the vigilance team of the police in the matter of theft of electricity in the last financial year and also provide the description of the first information reports in the matter of theft of electricity consistently. 

It is most unfortunate that after 4 months since the date of submission of the RTI application concerned public information officer did not provide the 5 points information to the information seeker. Consequently, public information officer violated subsection 1 of Section 7 of the right to Information Act 2005 so disciplinary proceedings must be initiated against the public information officer who made the mockery of the provisions of the right to Information Act 2005.
