Grievance Description-The matter concerns forgery in the public records from which name of the father of the applicant has been eliminated by taking concerned public staff under good faith. There is need of swift action in the matter with transparency and accountability so that conspirators may be sent behind the bar.

Subject-For registering First Information Report against the conspirators who hatched conspiracy to exclude the name of my father from the revenue records, family register under the possession of secretary of the village panchayat and cheating the property by colluding with the lekhpal, revenue inspector and tahsildar which was the share of my father.

The matter concerns the working of the sub divisional magistrate tehsil Lalganj district Mirzapur Uttar Pradesh. The following diseased is the father of the applicant whose address is as follows.

Siya Kant Mishra S/O Shambhusaran Mishra, village- Bhaisod Balay Pahad post-Daramalganj, tehsil-Lalganj, development block-Halia, District- Mirzapur Uttar Pradesh.

This application is under Article 51 A of the constitution of India to seek inquiry regarding the application made by the applicant before the sub divisional magistrate Lalganj dated 20th January 2023 with stamp of Rs.10 verified by the notary for the death certificate of my father Siya Kant Mishra S/O Late Shambhusaran Mishra which is attached as page 4 of the attached PDF documents to the grievance.

Brief description of matter in sequence.

1-Section 466 of the Indian Penal Code defines the offense of forgery of a record of a court of justice or of a Registrar of Births, etc., kept by a public servant. The offence is punishable by imprisonment for up to seven years and a fine.

2-Section 467 of the Indian Penal Code (IPC) 1860 pertains to the forgery of valuable security, will, or authority to make or transfer any valuable security, or to receive any money, movable property, or valuable security. The offence is punishable by imprisonment for life or imprisonment of either description for a term which may extend to ten years and is also liable to a fine. The offender may face imprisonment for life or imprisonment of either description for a term which may extend to ten years. The offender may also be liable to a fine.

3-Section 420 of the Indian Penal Code deals with the offence of cheating and dishonestly inducing the delivery of property.024 The offender who cheats and thereby induces the person deceived to deliver any property to any person, or to make, alter or destroy the whole or any part of a valuable security, or anything which is signed or sealed, and which is capable of being converted into a valuable security, shall be punished with imprisonment of either description for a term which may extend to seven years, and shall also be liable to fine.

4-Section 468. Forgery for purpose of cheating. Previous Next

Whoever commits forgery, intending that the 1 document or electronic record forged shall be used for the purpose of cheating, shall be punished with imprisonment of either description for a term which may extend to seven years, and shall also be liable to fine.

5-Section 471 of the Indian Penal Code (IPC) deals with the concept of using a forged document or electronic record as genuine. Anyone who fraudulently or dishonestly uses a forged document or electronic record as genuine which they know or have a reason to believe is forged will be punished in the same manner as if they had forged the document.14 The maximum punishment for this offence is imprisonment up to 7 years, and it is cognizable, non-bailable, and non-compoundable.
