अदालत ने कहा, एफआईआर दर्ज होने के बाद ही किसी को नोटिस दे सकते हैं । बिना नोटिस दिए थाने पर नहीं बुला सकते: हाईकोर्ट
लखनऊ, विधि संवाददाता हाईकोर्ट की लखनऊ बेंच ने एक महत्वपूर्ण आदेश में कहा है कि पुलिस किसी भी व्यक्ति को बिना लिखित नोटिस दिए थाने में नहीं बुला सकती न्यायालय ने राज्य सरकार को दिए आदेश में कहा है कि दंड प्रक्रिया संहिता के तहत ऐसी नोटिस एफआईआर दर्ज होने के बाद ही जारी की जाए। न्यायमूर्ति अरविंद मिश्रा प्रथम और न्यायमूर्ति मनीष माथुर की खंडपीठ ने यह भी कहा कि अधीनस्थ पुलिसकर्मी थाना इंचार्ज की अनुमति से ही ऐसा नोटिस जारी कर सकते हैं।

Article 21 of this part states that “No person shall be deprived of his life or personal liberty except according to the procedure established by law”, and this is known as the Right to Life and Personal Liberty. Hence, this Article prohibits the encroachment upon a person’s right to life and personal liberty against the state. In the aforementioned order, two things are core issue.
1-An individual may be summoned at the police station through proper notice.2- This notice must be served after registering first information report. 3- High court and the Supreme Court are the court of records so their orders are binding on the government and the subordinate courts.

1- Public information officer may provide the information about the steps taken by the government of Uttar Pradesh to comply with the direction of the Lucknow bench of the high court of Judicature at Allahabad.
2- Please provide the government order, circular and office memo issued by the government to comply with the direction of the court.
3- Please provide the minutes proceedings carried out by the government to comply with the order of the court.
4- Please provide the name and designation of the Government staff and the department of the Government who are processing the order of the Lucknow bench of the high court of Judicature at Allahabad.
We appreciate the steps of the high court of Judicature at Allahabad and government of Uttar Pradesh must also clarify its stand in the matter as the matter concerns the wide public interest and the safeguard of human and constitutional rights of the people in the state.
