It is quite obvious from the report dated 5th September 2023 AAP the circle officer police district Budaun. If the case number 214/2022, Mrs Kiran Rastogi versus Vimal Kumar Rastogi and others is pending before the court of 4th additional civil judge junior division district Budaun in this matter, how can activities of grabbing of the land contact place by the opposite party who is the litigant in the case?

Here core issue is the grabbing up the land by the opposite party while he has filed several litigations before the various courts even in the matter concerned this implies that he has no faith in the decision of the court and he is trying to decide the case before the disposal of the case in the court of the law which is a mockery of the of law of land.

It is quite obvious that the opposite party is alleging Vindictiveness against the applicant and his family members. The applicant is suffering with several ailments so most part of the time is being spent in the Noida because facilities are not available at the Budaun district. Those individuals who do not have faith in the decision of the court taking the law of land in their own hands by grabbing the land which is sub judice in the court of law itself-proving the criminal approach of the opposite party in the matter.

With this representation of the applicant, the report attached by the Honourable Sir in the above grievance of 3 pages and rest of the 9 pages is the affidavit submitted by the applicant before the court of the law, has been attached by the applicant which must be taken into account by the accountable staff of the police district Budaun.

The evidence provided by the applicant concerning the grabbing of the land by the opposite party is based on the CC TV footage record which is authentic and true.

The opposite party made the deliberate attempt to violate the provisions of the law so action must be taken against him as the mistakes of the fact can be avoided but the mistakes of the law can never be avoided.

Consequently F.I.R. must be registered against the opposition party including main conspirator Dinesh Gupta S/O R.D. Gupta and Shipra Gupta W/O Dinesh Gupta under the following sections of the Indian Penal Code.

Section 441 (Criminal Trespass): When someone unlawfully enters a property, or lawfully enters a property but unlawfully remains there (such as a tenant after expiration of tenancy) with the intent to commit an offence, or to intimidate, insult or annoy the person in possession of such property, it amounts to criminal trespass.

Section 425 (Mischief): When someone intentionally or knowingly causes destruction of a property or any change in a property that diminishes its value or utility, they are said to commit “mischief”.

Section 420 (Cheating): This provision is applied when someone cheats and deceives you into delivering any property to someone else.

#Section 442 (House Trespass): This is a form of “criminal trespass” wherein the trespasser unlawfully enters a human dwelling, or any building used as a place of worship or as place for the custody of property.

Section 503 (Criminal Intimidation): Any threat of injury to person, reputation or property with the intent to cause them to do something which they are not legally bound to do is a form of criminal intimidation

Grievance Description-Today the applicant has made a call to the concerned sub inspector and made complaint in the matter in detail, but it is most unfortunate that sub inspector did not visit the site. There is little distance between the police chowki and the House of the applicant. Earlier sub inspector has made investigation in regard to the case registered and filed charge sheet under section 323, 504 and 506 of the Indian Penal Code.

The matter concerning the working of the circle officer City district Budaun to direct his subordinates to take action in the matter as offender are trying to grab the land quite obvious from his cryptic and mysterious activities.

The applicant has attached the several photographs with the attached PDF documents to this grievance. Honourable sir may be pleased to take the perusal of the attached photographs to the grievance for the next action in the matter. It is most unfortunate that the police did not reach to the site of dispute which is a matter of great concern.

The opposition party may not be allowed to use my land and keep his own articles in the land of the applicant because after some time he will declare my land as his own land and will create new controversy so at the initial stage police may ask them to vacate the land as soon as possible and not to trespass in my land.

How can opposition party may be allowed to reap the benefits of vulnerability of the applicant which is quite obvious from the encroachment of the opposition party into the land of the applicant and the lackadaisical approach of the concerned police who could not reach to the site of dispute?

The mensrea of the opposition party is quite obvious from the fact that police have registered the case against them, yet they are taking the law of land in their own hand. The act itself does not make a man guilty unless he intends so and here intention is quite explicit from the fact that they are interested to grab the land of the applicant so first information report must be registered against them for the grabbing of the land of the applicant if they are not removing their articles from the land of the applicant.

Short submissions in the matter is as follows.

1-The applicant named Vimal Kumar Rastogi address- Garhaiya , Shahbajpur, Patiyali Sarai Pode 243601 State Uttar Pradesh is a senior citizen, and he is being constantly harassed by the habitual offenders.

2-It is noticeable that police have registered case under section 323, 504 and 506 of the Indian penal code against opposition party Dinesh Gupta S/O R.D. Gupta and Shipra Gupta W/O Dinesh Gupta in which charge sheet has been filed.

3-The applicant wants to inform the honourable Sir that the opposition party is habitual offender he has fabricated 6 frivolous cases in various courts including civil and revenue courts. Honourable Sir may be pleased to take a glance of the attached PDF documents to the grievance.

4-Honourable Sir it is the obligatory duty of the opposition party when they are seeking justice in the court of law by filing multiple suits then why they are grabbing the land by using cunning tricks and reaping the vulnerability of the applicant.

5-Consequently F.I.R. must be registered against the opposition party including main conspirator Dinesh Gupta S/O R.D. Gupta and Shipra Gupta W/O Dinesh Gupta under the following sections of the I.P.C. .
