* Prayer or Relief Sought Additional deputy Commissioner of Police took the recourse after following two provisions of the right to Information Act 2005 to deprive the appellant from the sought information concerning wide public interest. Under subsection 1(j) of Section 8 of right to Information Act 2005 following information is exempted from disclosure- information which relates to personal information the disclosure of which has no relationship to any public activity or interest, or which would cause unwarranted invasion of the privacy of the individual unless the Central Public Information Officer or the State Public Information Officer or the appellate authority, as the case may be, is satisfied that the larger public interest justifies the disclosure of such information: Provided that the information which cannot be denied to the Parliament or a State Legislature shall not be denied to any person. Public information officer in the commissioner rate Gautam Budh Nagar Uttar Pradesh took the above provision of the right to Information Act to withhold the sought formation. Under subsection 1 (h)of Section 8 of right to Information Act 2005 following information is exempted from disclosure- information which would impede the process of investigation or apprehension or prosecution of offenders;
The appellant sought the following information from the public information officer.
1-Public information Officer may provide the current status of investigation in the aforementioned matter.
2-Since the matter concerns deep-rooted corruption so the first information report is registered by the concerned police in the matter, the copy must be made available to the information seeker.
3-Public information Officer may provide the name and designation of the investigation officer in the matter.
4-If the concerned police team exchanges any communication with the central agencies like ministry of Home affairs and ministry of finance then provide the copy of the communication exchanged with the central agency.
5-If the charge sheet has been sent to the competent court in the matter, then provide the date and time and minutes of proceedings in this regard.
It seems that public information officer did not read the following quote as follows. Provided that the information which cannot be denied to the Parliament or a State Legislature shall not be denied to any person.
Here information sought under point 4 does not concern with the investigation of the police officer so this information must be made available to the appellant as well as when the investigation is over then the rest of the information should be made available by the public information officer
