Suggestion of U.P.H.R.C. -If the complainant has any grievance against the S.H.O. of Police Station of Mauaima he may approach the Police Commissioner, Prayagraj who shall look into the matter and pass an appropriate order.

Following grievance was submitted by the applicant on PMO portal in order to pursue the suggestion of the Uttar Pradesh Human Rights Commission as aforementioned.

Subject -Please direct the competent officer to check the role of the station house officer Mauaima for implicating Saurabh Singh and his father Tej Bahadur Singh under the false charges by falsely implicating under various sections of IPC to both of them.

Ipso facto I have sought an enquiry against S.H.O. Mauaima not information which implies that concerned staff who made the comment महोदय IGRS प्रणाली में RTI से सम्बन्धित सूचना देय नही है is incompetent for post. When he can not understand the contents of the grievance, how can he redress the grievances of the aggrieved people?

Since the matter concerns deep rooted corruption in the working of the police which is causing false FIR against innocent and gullible people so the applicant is making enquiry, Unfortunately, state government functionaries are running away from the matter of wide public interest because they themselves are supporting corruption in the government machinery quite obvious from their lackadaisical approach the matter. This matter shows that state has derailed.

I pray before the Honourable Sir that 51A. Fundamental duties It shall be the duty of every citizen of India a- to abide by the Constitution and respect its ideals and institutions, the National Flag and the National Anthem (h) to develop the scientific temper, humanism and the spirit of inquiry and reform (i) to safeguard public property and to abjure violence (j) to strive towards excellence in all spheres of individual and collective activity so that the nation constantly rises to higher levels of endeavour and achievement.

According to the Honourable member of the State human rights commission Lucknow, in the commission remedy is available against unfair investigation by police but in commission there is no remedy if the police abuses their power and rank to implicate a person under false charges to wreak vengeance as the victim made efforts to register FIR against the criminal elements who had sympathy of the police concerned.

Perused the complaint of Sri Yogi M P Singh dated 31.03.2023.

It appears that the victim is an accused in case crime no 98/2023 under section 323/504/506/427/354/380 of Police Station Mauaima District Prayagraj. He alleges that he has been falsely implicated in the aforesaid case. The issue regarding the innocence of the complainant cannot be decided by the Commission as the same falls within the domain of investigation. There is no allegation in the complaint that the case is not being investigated fairly.

Grievance Description

An application under Article 51A of the constitution of India on behalf of Saurabh Singh alias Rajan Singh son of Tej Bahadur Singh to seek enquiry against station house officer police station Mauaima District Prayagraj, Uttar Pradesh.

The fault of the victim Sourabh Singh alias Rajan Singh son of Tej Bahadur Singh is that he was requesting station house officer Mauaima to register an FIR in the matter in which victim was mercilessly beaten by the offenders.

Whether the victim and his father have no right to register a first information report against the criminal elements who assaulted the victim mercilessly in this largest democracy in the world. Undoubtedly it is travesty of justice which must be looked into by the Commissioner of Prayagraj to save the credit of the Prayagraj police.

The matter is amenable before the Commissioner of Prayagraj district Prayagraj as directed by the State human rights commission of Uttar Pradesh.
