I have perused the allegations made in the complaint of complainant Sri Mahesh Pratap Singh.

Looking to the nature of allegations made in the complaint it would be appropriate to call for a report from the Police Commissioner, Prayagraj who shall look into the matter and after necessary inquiry associating the complainant, send his report to the Commission on or before 02.08.2023.

MauAima instead of registering F.I.R. of the victim put him in a lockup and registered false cases against not only the victim but his father as well by misusing his post and power. The injuries are reflecting at the bodily organs of the victim and quite obvious from the medical examination reports of the victim carried out by the MauAima police itself at the Phoolpur primary health care centre by the government doctor attached to the petition. 

2-It is submitted before the Honourable Sir that in general, no F.I.R. is registered by the police on the straight complaint of the victims. It is quite obvious that the police registered a case under section 151,107 and 116 of the criminal penal code on the direction of assistant commissioner of police, circle Phoolpur, Prayagraj on 01 March 2023.

On the same day, in the night at two minutes past 9 o clock, police registered six serious cases in the same matter under six serious sections of the Indian penal code not only against the victim Saurabh Singh who was in the lock up of the MauAima police but his father-Tej Bahadur Singh as well.

The copy of the F.I.R. is attached to the petition and the case filed against the victims under the following sections of the Indian Penal Code. 

1-Under section 323 of the Indian Penal Code 1860.

2-Under section 504 of the Indian Penal Code 1860.

3-Under section 506 of the Indian Penal Code 1860.

4-Under section 427 of the Indian Penal Code 1860.

5-Under section 354 of the Indian Penal Code 1860.

6-Under section 380 of the Indian Penal Code 1860.

 3- I pray before the Honourable Sir that Saurabh Singh was mercilessly beaten who had gone to lodge FIR along with his father at Mauaima police station but instead of registering F.I.R., S.H.O. Mauaima put him in lockup but concerned thought that Saurabh still pressed them to lodge F.I.R. against offenders on contrary S.H.O. Mauaima registered F.I.R. against the victim and his father to teach them is the blatant misuse of power by the police in order to teach a lesson to common people.

4- If police is really honest to duty, an impartial enquiry may be ordered to ensure the accountability of concerned police personnel and register a case under appropriate section of Indian penal code against offenders so that injustice done to the victim may be sorted out. Sir, this is a travesty of justice and reflection of anarchy in the working of the police. Please curb this anarchy through an impartial enquiry in the wide public interest.

5-S.H.O. Mauaima not only played with power tools provided him for the safeguard and protections of the rights of the citizens in a negligent manner but violated the human rights of the victims by fabricating them under false charges to deviate the attention from the core issue.

Whether the attached report will be submitted before the Human Rights Commission Lucknow in respect of following order? It is well known fact that commissioner of police will order one of the assistant police commissioners in the matter to carry out investigation and then findings will be submitted before the U.P.H.R.C. Lucknow. Consequently action will be taken in the matter.
