The staff of the assistant labour commissioner Mirzapur submitted false, arbitrary and inconsistent report in the aforementioned grievance. Please help the applicant for transparent and accountable proceedings.

The matter concerns the arbitrariness of the Assistant Labour commissioner, District-Mirzapur, Uttar Pradesh during the delivery of the quasi-judicial function. An Open court is a normal court where proceedings of the court are conducted. To the extent practical, every person is allowed to watch the proceedings of the court. The concept of hearing in an open court is practiced because it brings transparency in administration of justice. The parties get to know what is happening and inculcate discipline and caution in the minds of all those involved in administering justice.


There must be transparency and accountability in the working of the assistant labour commissioner which must conform to the set up norms of the quasi-judicial proceedings.

The matter concerning the sanctity in the proceedings of the quasi judicial court and from the attached report by the staff of the assistant labour commissioner it is quite obvious that concerned staff did not understand the contents of the submitted complaint.

Whatever submissions are made before the assistant labour commissioner by the applicant is being arbitrarily overlooked by him which is the root cause of such complaints.

Whether it is not showing the arbitrariness and tyranny in the working of the assistant labour commissioner that the applicant is being overlooked in the case by him and submissions of the applicant are being overlooked merely on the ground that applicant is not an advocate he is compelling the applicant that applicant may hire an advocate for the court proceedings. The economical condition of the applicant is not allowing the applicant to hire an advocate.

Why the assistant labour commissioner is preferring an advocate instead of sticking to law points is itself a matter of concern.


Whether it is justified to refuse to take the representation of the applicant who is appearing in person before the court to represent his case as defender. My representation is annexed with this application. The applicant sent his representation to the court by the speed post which scanned-copy is attached to the grievance. Think about the transparency and accountability in the discharge of quasi-judicial function in the state of Uttar Pradesh. Here there is no supremacy of the law but the desires of the presiding officer are supreme. In Indian courts, presiding officers always dislike petitions in person, people arguing their own cases because of cryptic dealing in court proceedings.
