Grievance Description

The matter concerning Sushila Devi, wife of Hiralal Vishwakarma is being overlooked by the concerned police and the tehsil Lalganj.The details of the victim are as follows.Sushila Devi W/O Hiralal Vishwakarma Address -Village-Semari Kalan, Post- Kanokhar, Tehsil -Lalganj, District -Mirzapur, PIn Code 231211, Panchayat Rajai, mobile number-9129540377 The details of the land grabbers are as follows.1-Shivchand son of Shri Ram VishwakarmaHe is posted as the Home guard so influences the activity of the police.The address is as aforementioned.2-Dilip Kumar Son of Shri Ram VishwakarmaThe address is as aforementioned.

Respected Sir who has given the authority to the opposite party to grab the land of the drainage which has been decided by the deputy director of consolidation. Whether the opposite party is not encroaching the direction passed by the deputy director of consolidation in regard to the controversial land that it belongs to the drainage.

122B. Powers of the Land Management Committee and the Collector. - (1) Where any property vested under the provisions of this Act in a Gaon Sabha or a local authority is damaged or misappropriated or where any Gaon Sabha or local authority is entitled to take or retain possession of any land under the provisions of this Act and such land is occupied otherwise than in accordance with the provisions of this Act, the Land Management Committee or local authority, as the case may be. shall inform the Assistant Collector concerned in the manner prescribed.

(2) Where from the information received under sub-section (1) or otherwise, the Assistant Collector is satisfied that any property referred to in sub-section (1) has been damaged or misappropriated or any person is in occupation of any land, referred to in that sub-section, in contravention of the provisions of this Act, he shall issue notice to the person concerned to show cause why compensation for damage, misappropriation or wrongful occupation as mentioned in such notice be not recovered from him or, as the case may be, why he should not be evicted from such land.

Here it is quite obvious that the matter invites the remedy under the aforementioned subsection 1 of section 122 B of the The U.P. Zamindari Abolition and Land Reforms Act, 1950 but not feasible because of impeccable integrity of the Lekhpal concerned.

Short submissions are as follows.

1-It is quite obvious from the first and second page of the attached documents to the grievance that earlier controversial land belongs to the applicant but later on deputy director of consolidation decided this land belongs to the drainage.

2-The opposite party has muscle power and they always create disputes and hurls abuses on the family members of the applicant. They are making efforts to grab the controversial land belonging to the drainage as decided by the deputy director of consolidation. 

3-respected Sir who has given the authority to the opposite party to grab the land of the drainage which has been decided by the deputy director of consolidation. Whether the opposite party is not encroaching the direction passed by the deputy director of consolidation in regard to the controversial land that it belongs to the drainage.

4-The third and fourth page of the attached PDF document to the grievance is the report of the lekhpal submitted by the tehsil Lalganj on the jansunwai portal government of Uttar Pradesh. Instead of resolving the issue, lekhpal bade Lal Dube is submitting cryptic and mysterious reports and making the issue complicated instead of resolving it.

5-Undoubtedly the family of the applicant is living in a transitory land quite obvious from the report of the lekhpal Bade Lal Dube but why opposite party is grabbing the land of the drainage if this land does not belong to the Drainage then lekhpal concerned may explain it what type of land is this? 

6- Think about the gravity of situation lekhpal Bade Lal Dube submitted the report without visiting the site which is an indiscipline job so he must be punished by the concerned tahsildar Lalganj.

7-Whether the land of drainage is left by the government to grab by the muscle man as being done by the opposite party? On one side of a screen government of Yogi Adityanath ji is advocating to take harsh steps against the land mafia but on the other side of the screen lekhpal Bade Lal Dube and the other staff supporting the land grabbing by the opposite party.
