With due respect, the applicant invites the kind attention of the Honourable Sir to the following submissions as follows.
1-I pray before the Honourable Sir that 51A. Fundamental duties It shall be the duty of every citizen of India (a) to abide by the Constitution and respect its ideals and institutions, the National Flag and the National Anthem;(h) to develop the scientific temper, humanism and the spirit of inquiry and reform;(i) to safeguard public property and to abjure violence;
(j) to strive towards excellence in all spheres of individual and collective activity so that the nation constantly rises to higher levels of endeavour and achievement.
2-It is submitted before the Honourable Sir that The matter concerns land grabbing but the concerned police are not taking any action questions integrity of the police ipso facto. It is quite obvious that land grabbers have grabbed the entire while they purchased the part of land and threatened the police and Tehsil staff and denied to accept the boundary decided by the Lekhpal under section 24 of revenue code 2007. In reference to these grievances and submitted reports of Lekhpal concerned registration number: PMOPG/E/2023/0005044 and registration number: PMOPG/E/2023/0008499.
3-I pray before the Honourable Sir that An application under article 51A of the constitution of India on behalf of my father Gulabdhar Maurya Son of late Amarnath Maurya resident of village and post Lohiya Talab district Mirzapur to make enquiry regarding land grabbing of the opposite party and police is mute spectator and harassing the victim only. Section 441 (Criminal Trespass): When someone unlawfully enters a property, or lawfully enters a property but unlawfully remains there (such as a tenant after expiration of tenancy) with the intent to commit an offence, or to intimidate, insult or annoy the person in possession of such property, it amounts to criminal trespass. Section 425 (Mischief): When someone intentionally or knowingly causes destruction of a property or any change in a property that diminishes its value or utility, they are said to commit “mischief”. Section 420 (Cheating): This provision is applied when someone cheats and deceives you into delivering any property to someone else. #Section 442 (House Trespass): This is a form of “criminal trespass” wherein the trespasser unlawfully enters a human dwelling, or any building used as a place of worship or as place for the custody of property. Section 503 (Criminal Intimidation): Any threat of injury to person, reputation or property with the intent to cause them to do something which they are not legally bound to do is a form of “criminal intimidation”.
4-It is submitted before the Honourable Sir that In reference to these grievances and submitted reports of Lekhpal concerned registration number: PMOPG/E/2023/0005044, registration number: PMOPG/E/2023/0005044.
From the report of the Lekhpal concerned, it is quite obvious that the opposite party has grabbed the entire land and is not interested to leave the grabbed land. Here the applicant is not the co-shareholder of the land but paid the price of the land and title has been decided by the concerned magistrate during the process mutation. Therefore, the applicant is the undisputed landlord and boundary of the land has been decided by the Tehsil and police, but possession could not be provided because opposite party members are notorious criminals as mentioned by the applicant in his earlier applications. Both police and Tehsil are frightened of them. The boundary of the land after mutation has been decided and Lekhpal itself accepted it his report that opposite has grabbed the entire land while in accordance with the law, they must claim for the piece of land purchased by them not the entire land consequently opposite party is reaping the benefit of muscle power and peace-loving nature of the applicant in the matter.
Section 116 of revenue code 2006 states as follows. Section 116 UP Revenue Code Description(1) A bhumidhar may sue for the division of the holding of which he is a co-sharer.(2) In every such suit, the Court may also divide the trees, wells and other improvements existing on such holding but where such division is not possible, the trees, wells and other improvements aforesaid and valuation thereof shall be divided and adjusted in the manner prescribed.(3) One suit may be instituted for the division of more holdings than one where all the parties to the suit other than the Gram Panchayat are jointly interested in each of the holdings.(4) To every suit under this section, the Gram Panchayat concerned shall be made a party.
5-I pray before the Honourable Sir that here whatever land is purchased by the opposite party, they must confine themselves to the same land but because of their criminal nature they are trying to take the law of land under their teeth by grabbing the land of the applicant of which title is in the name of the applicant quite obvious from the report of the Lekhpal.
लेखपाल की रिपोर्ट के मुताबिक शिकायतकर्ता और विपक्ष दोनों ने जमीन खरीदी, लेकिन विपक्ष पूरी जमीन हड़प रहा है। पुलिस और तहसील दोनों ने कब्जा करने वालों से अनुरोध किया लेकिन उन्होंने अनुरोध को अस्वीकार कर दिया। निस्संदेह यह रिपोर्ट तहसील की हताशा है और वे मामले से बच रहे हैं। लेखपाल जमीन हड़पने के मामले में शिकायतकर्ता को राजस्व संहिता 2006 की धारा 116 के तहत मुकदमा दायर करने का बेतुका सुझाव दे रहा है।

This is a humble request of your applicant to you, Hon’ble Sir, how can it be justified to withhold public services arbitrarily and promote anarchy, lawlessness and chaos arbitrarily by making the mockery of law of land? There is need of the hour to take harsh steps against the wrongdoer to win the confidence of citizenry and strengthen the democratic values for healthy and prosperous democracy. For this, your applicant shall ever pray for you, Hon’ble Sir.

An application under article 51A of the constitution of India on behalf of my father Gulabdhar Maurya Son of late Amarnath Maurya resident of village and post Lohiya Talab district Mirzapur to make enquiry regarding the compliance of the endorsement order passed by the Honourable sub divisional magistrate Sadar Mirzapur 28 September 2021. This order was addressed to the station house officer Kotwali Katra district Mirzapur quite obvious from the second page of the attached documents.

यह बेतुका सुझाव तब आया जब राजस्व संहिता 2006 की धारा 24 के तहत भूमि की सीमा तय की जा चुकी है। The applicant made the application under section 24 of the revenue code 2006 to decide the boundary of the land on the suggestion of the staff of the department of revenue tehsil Sadar and pai mise of the land was made by the concerned lekhpal but still no action taken by the department of revenue and police concerned to provide the possession of the land to the applicant so that fear of the land mafia may end.
