Sir, everyone knows that police are blatantly misusing the section 151/107/116 of Cr.P.C. even when the government has issued the circulars after adequate guidelines provided by the High of Judicature at Allahabad. Instead of taking action in the matter through logistic approach C.O. Budaun supports the quotes of the subordinate without thinking about pros and cons.

Which canon of law allows the police not to take action on the representation of old age people concerning criminal offence of the offenders merely on the ground that civil suit filed in the matter and the matter is sub judice. Whether the applicant is saying that dear police personnel please dispose of my civil suit, if not so why this cryptic dealings to fabricate the applicant for breach of peace in order to frustrate him to seek justice?

Vimal Kumar Rastogi a senior citizen fabricated under section 107/116 of Cr.P.C. because he submitted representation on Jansunwai portal which is violation of a circular issued by government on 09 September 2021 to comply with the guideline issued by High court of Judicature at Allahabad. Everyone knows that proceedings under Section 107/116. of the Cr. P.C. are only preventive measures and not pure criminal proceedings, but such proceedings are of quasi-judicial nature, undoubtedly offenders are inviting pure criminal proceedings, so my matter is not amenable under section 107/116. Moreover you/police fabricated the applicant who is a senior citizen under aforementioned sections of criminal penal code to wreak vengeance of submitting a complaint on the Jansunwai portal of the government of Uttar Pradesh. Herewith signed application of the complainant addressed to chief minister government of Uttar Pradesh is attached to this representation signed by the aggrieved. D.G.P. office is the monitoring head of the department of police in the state of Uttar Pradesh through which the state government monitors and ensures the law and order in the state. It is the foremost responsibility of the D.G.P. office to safeguard the rights of people and curb the misuse of provisions of law of land.

1-Whoever seeks redressal of their grievances by submitting online applications on the Jansunwai portal of the government of Uttar Pradesh, concerned sub-inspector fabricate them under Section 107/116. of the Cr. P.C in most of the cases.

Please provide the measures taken by the D.G.P. office to curb the misuse Section 107/116. of the Cr. P.C. including a copy of the circulars issued through the office.

2-The job of police is to be instrumental in providing criminal justice, specially to justice seekers and police in most of the cases lodge F.I.R. under Section 107/116. of the Cr. P.C. which is a preventive measure.

Please provide the minutes of proceedings and circulars issued to check the trend of local police who have made illegal practices to misuse the Section 107/116. of the Cr. P.C.in order to provide justice by the D.G.P. office.

3-शिकायतकर्ता द्वारा असंतुष्ट फीडबैक प्राप्त होने पर उच्च अधिकारी को पुनः परीक्षण हेतु प्रेषित. क्षेत्राधिकारी / सहायक पुलिस आयुक्त-बदायूँ,जनपद-बदायूं 17-09-2022 आख्या श्रेणी - वाद-न्यायालय में विचाराधीन है / स्थगित है This implies that offenders are grabbing the land and assaulting the old age information seeker and his wife which is violation of stay order.

Please provide the copy of F.I.R. which implicates information seeker under Section 107/116. of the Cr. P.C. as old age husband and wife have been a danger to peace and tranquillity according to biased police.

श्रीमान जी प्रकरण का संबंध पुलिस द्वारा अभियुक्तों के खिलाफ कार्यवाही न किए जाने से संबंधित है किंतु प्रकरण को जमीनी विवाद से जोड़कर पुलिस द्वारा मामले से पल्ला झाड़ लिया गया श्रीमान जी पुलिस का कहना है कि प्रार्थी पर किए गए हमले का कोई प्रमाण नहीं है और वह एक शब्द में लिख दिया प्रमाण नहीं किंतु ऐसा नहीं है यदि प्रार्थी पर हमला ना हुआ होता तो प्रार्थी क्यों प्रयास करता क्षेत्राधिकारी महोदय कहते हैं कि प्रार्थी वरिष्ठ नागरिक है तो क्या सरकार वरिष्ठ नागरिकों की सुरक्षा के मामले में कोई कार्यवाही नहीं करना चाहती प्रार्थी का मान मर्दन गालियों द्वारा दबंगों द्वारा क्यों किया गया पुलिस द्वारा उचित कार्यवाही क्यों नहीं की गई क्या मामले का निदान धारा 151 107 और 116 क्या प्रार्थी को न्याय प्रदान करने में सक्षम हैं श्रीमान जी यहां तो अपराध कारित हो चुका है मुलजिमों के खिलाफ कार्यवाही होनी चाहिए किंतु पुलिस कार्यवाही करने से भाग रही है जो कि किसी भी तरह से उचित नहीं है कृपया मुलजिमों को उचित दंड दिया जाना चाहिए जिससे कि वे भविष्य में दुस्साहस करने का साहस न जुटा सके हमें कार्यवाही की आवश्यकता
