Please provide feedback under article 51 A, regarding payment wages to staff of strike period from 16 December 2021 onward as branch closed and opened after four days i.e. on Monday.
Punjab-Haryana High Court Pgi Employees Union vs Director, Post Graduate However it cannot be said that the strike was illegal because they had proceeded on strike after giving notice as required by Section 22 of the Industrial Disputes Act. However, claim to strike pay is not authorised by law for the strikers voluntarily abstained from work. Strike pay is awarded only as a measure of social justice by the Industrial Tribunal on account of economic disparity between employer and employees and parties are adversely affected by the strike. So in such circumstances workers have no legal right to claim pay for strike period. However, on sympathetic grounds I order that 25 percent of the total strike period amount to be paid to the workers. Apex court of India had categorically passed the order no work no pay Principle Of 'No Work No Pay' Applies When Employee Was Not Kept Away From Work By Any Order Of Employer: SC Read Judgment Nobody could be directed to claim wages for the period that he remained absent without leave or without justification. The Supreme Court has observed that the principle of 'No Work No Pay' can be applied when the employee was not kept away from work by any order of the employer. The bench comprising Justice Ashok Bhushan and Justice Navin Sinha, reiterated the settled principle that nobody could be directed to claim wages for the period that he remained absent without leave or without justification. As far as that employees have not left their two days salary voluntarily and this deduction in the salary of the strikers will effect under the advice note of the competent authority. It is most unfortunate that the concerned branch manager did not provide any evidence regarding non-payment of the salary of the striking period. It may be that the branch manager was concerned that in order to keep my protest against the strikers stopped, he apparently replied in his own hand writing but it may not be the integral part of the proceedings of the department. If the government had any decision regarding the deduction of the salary of 9 Lakhs strikers, then it would remain fed the print and electronic media as well as vernacular dailies. Undoubtedly, it is a welcome step if the principle of no work no pay was followed by the employer. In a good governance every thing must be transparent and accountable.

Please provide the INFORMATION regarding the staffs of the branch who were paid salary and who were not paid because they went on strike. Provide the details of staffs at the branch office Mirzapur went on strike voluntarily and also those were coerced to go on strike. Your reply as -The branch was closed due to nationwide strike of Bank on 16th and 17th of December 2021. No question of permission is involved in it. and All the staffs were on strike. It is most unfortunate that you did not provide the details of the staff as sought by the applicant. You ought to provide the copy of the competent authority who advised the deduction of the salary of the strikers. In wide public interest, such landmark decisions must be in the public domain.
