((Description of Information sought (upto 500 characters) )

* Prayer or Relief Sought All judges of the lower judiciary up to the level of district judge are selected through the Provincial Civil Services (Judicial) exam. PCS(J) is commonly referred to as the judicial services exam. The selection process is conducted by the State Public Service Commissions and the concerned High Court, since High Courts exercise jurisdiction over the subordinate judiciary in the state. Panels of High Court judges interview candidates after the exam and select them for appointment. Appointments of judicial service are made by Governor after consulting high court and state public service commission. Appointments of judicial service below district judge are made by high court. A district judge or additional judge may be removed from his office by the governor on conformation from the high court collegium. Which means appointment and removal of the judges in the subordinate courts subject to the government of Uttar Pradesh and ministry of law is concealing the information from the information seeker by adopting various cunning tricks including procrastination. NO.10/2/2008-IR Government of India Ministry of Personnel, Public Grievances & Pensions Department of Personnel & Training North Block, New Delhi North Block, New Delhi Dated: the 12th June, 2008 According to subsection 4 of section 3 of the aforementioned office memorandum (iv) If a person makes an application to a public authority for some information which is the concern of a public authority under any State Government or the Union Territory Administration, the Central Public Information Officer (CPIO) of the public authority receiving the application should inform the applicant that the information may be had from the concerned State Government UT Administration. Application, in such a case, need not be transferred to the State Government UT Administration. Following is the Hindi translation of the manipulated office memorandum provided by the First Appellate Authority who tried to mislead the information seeker by substituting CPIO by PIO and unnecessarily including Uttar Pradesh. It is quite obvious that office memorandum of the ministry of personnel and training is for the CPIOs of the central government but it is reflecting insolence of the incompetent of the First Appellate Authority who made failed attempt to mislead the information seeker. More detail is attached to this online appeal in PDF form.

((Description of Information sought (upto 500 characters) )

* Description of Information Sought Corruption has a direct impact on the validity of human rights, largely because of two reasons. On one side, corruption deprives societies of important resources that could be used for basic needs, such as public health, education, infrastructure, or security. On the other hand, corruption has direct damaging consequences in general on the functioning of state institutions, and in particular on the administration of justice. Corruption decreases public trust in justice and weakens the capacity of judicial systems to guarantee the protection of human rights, and it affects the tasks and duties of the judges, prosecutors, lawyers, and other legal professionals. By seeking impunity, corruption has a devastating effect on the judicial system as a whole. One of the goals of human rights is to fight corruption and its implications on the administration of justice, as is to act against corruption through an independent and strong administration of justice. PIO may provide the following information to the information seeker point wise as sought.

1-Department of justice may provide the initiatives of the government of Uttar Pradesh undertaken by it to overcome the growing corruption in the state judiciary as law order can not be maintained through a derailed judiciary in the state for the last five years.

2-Please provide the statistics of the government of taking action against the wrongdoer judicial members against whom action taken by the Government of Uttar Pradesh on the complaints of allegations of corruption of the last five years.

  2. Because of the rampant corruption in the government machinery Bhartiya Janata party did not take any action in the matter of corrupt judges and it only set the corrupt judges free who were found indulging in the deep rooted corruption.
