Fifty representations and repeated RTI requests and subsequent appeals, recovery of penalties imposed on 4 PIOs could not be carried out
With due respect, the applicant invites the kind attention of the Honourable Sir to the following submissions as follows.
1-1-I pray before the Honourable Sir that 51A. Fundamental duties It shall be the duty of every citizen of India (a) to abide by the Constitution and respect its ideals and institutions, the National Flag and the National Anthem;(h) to develop the scientific temper, humanism and the spirit of inquiry and reform; (i) to safeguard public property and to abjure violence;
(j) to strive towards excellence in all spheres of individual and collective activity so that the nation constantly rises to higher levels of endeavour and achievement. 2-I pray before the Honourable Sir that transparency ombudsman Uttar Pradesh State Information Commission itself creates hindrance in the path of Information seekers by arbitrarily rejecting genuine appeals of information seekers through its registry cryptically by adopting corrupt approaches. Regarding recovery of penalties, both administration and transparency ombudsman are not interested in compliance with the order of recovery of penalty passed under section 20 of the Right to Information Act 2005. 3-It is submitted before the Honourable Sir that Registration Number UPICM/R/2021/60157 Name Yogi M P Singh Date of Filing 13/08/2021 Status REQUEST TRANSFERRED TO OTHER PUBLIC AUTHORITY as on 02/09/2021 Details of Public Authority :- DISTRICT MAGISTRATE OFFICE MIRZAPUR. vide registration number: - DMOMR/R/2021/80054 respectively. Short submissions are as follows.1-Public authority Uttar Pradesh Information Commission received the aforementioned RTI request on 13 Aug 2021, concerned PIO transferred it to D. M. Mirzapur on 02 Sept 2021 and today is 22 Oct 2021 which means one month 20 days passed but information was not made by the concerned public information officer of the public authority office of District Magistrate Mirzapur within stipulated time 30 days as prescribed under subsection 1 of section 7 of the Right to Information Act 2005 consequently PIO violated the subsection 1 of section 7 of the Right to Information Act 2005 which invites action under disciplinary proceeding awarded to undisciplined staff of the government. In the aforementioned RTI Application, appellant sought six-point information concerning the recovery of pecuniary penalties imposed on the wrongdoer public information officers but it is most unfortunate that his working style is cryptic and mysterious in the matter. From the circumstantial evidence, it is quite obvious that the public information officer itself shields the corrupt activities by concealing the information from the aggrieved people in a cryptic and mysterious way. Think about the gravity of situation that multiple years passed since the date order of recovery was issued by information commission, government of Uttar Pradesh ipso facto obvious from the attached document to the appeal but no recovery was made by concerned and information commission, government of Uttar Pradesh itself not serious about the recovery is not only surprising but reflects anarchy in the working of the information commission, government of Uttar Pradesh itself. Whether any PIO will provide information to the information seekers if there is no fear of penal action imposed under section 20 of the Right to Information Act 2005 by the information commission, government of Uttar Pradesh. Undoubtedly the matter is serious as both the public authorities failed to provide information under Right to Information Act 2005 concerning the recovery of imposed penalties which means no recovery is made after order of penalty on the erring public information officers. This reflects sheer anarchy in the working of the government of Uttar Pradesh.

This is a humble request of your applicant to you Hon'ble Sir that how can it be justified to withhold public services arbitrarily and promote anarchy, lawlessness and chaos arbitrarily by making the mockery of law of land? There is need of the hour to take harsh steps against the wrongdoer to win the confidence of citizenry and strengthen the democratic values for healthy and prosperous democracy. For this, your applicant shall ever pray for you, Hon'ble Sir.
