The doctrine of no-work-no-pay is a fundamental axiom in industrial relations. The philosophy are very simple. When a person is employed, it is expected that the work assigned will be carried out. When this work is not done, the employee is not eligible for payment of any salary.
No work, no pay" lays a strong foundation to industrial peace and harmony in the long run.

New Delhi: In a judgement with wider ramifications, the Delhi High Court has held that there would be no wage for the period the workmen went on strike.
With due respect, the applicant invites the kind attention of the Honourable Sir to the following submissions as follows.
1-1-I pray before the Honourable Sir that 51A. Fundamental duties It shall be the duty of every citizen of India (a) to abide by the Constitution and respect its ideals and institutions, the National Flag and the National Anthem;(h) to develop the scientific temper, humanism and the spirit of inquiry and reform; (i) to safeguard public property and to abjure violence;
(j) to strive towards excellence in all spheres of individual and collective activity so that the nation constantly rises to higher levels of endeavour and achievement. 2-I pray before the Honourable Sir that Please provide feedback under article 51 A, regarding payment wages to staff of strike period from 16 December 2021 onward as the branch closed and opened after four days i.e. on Monday.

However, claim to strike pay is not authorised by law for the strikers voluntarily abstained from work. 3-It is submitted before the Honourable Sir that unions of the Bank staffs belonging to public sector banks went on strike to keep the public services at ransom and show its power to government that if government will privatise the public sector banks, they will go on strike which will last longer than the agitation of the farmers quite obvious from their challenges published in the print and electronic media. Whether such strikes are legal, are staged to show its strength and influence to the government by keeping the public services at ransom.
4-It is submitted before the Honourable Sir that I had visited the branch office with her mother to submit requisite documents offline but the entire staff of the Bank of India had gone on strike. Therefore the gate was locked but no notice on the entrance. When I enquired neighbours, then neighbours told me that the Bank will remain closed until Sunday and will reopen on Monday. Think about the gravity of the situation that No work no pay has been passed by the apex court of India and strictly warned that no one may be allowed to keep the public services at ransom to create undue pressure on the employer. Afterall I have submitted all required documents.
Applicant is itself victim of lawlessness and anarchy imposed by the bank staff and insensitivity of the concerned government functionaries ipso facto.
5-I pray before the Honourable Sir that undoubtedly innocent and gullible people suffered four day delay but these strikers will draw two days salary illegally causing loss to public exchequer more than INR 180 Crore which must be withheld by government as required under law. These bank staff are pure public servants who are not allowed under the law to go on strikes to show their power in order to dominate the government. Public exchequer is subjected to public and those drawing emoluments of salary from the public chequer, how can they withhold the public services to create hardships to the public.

This is a humble request of your applicant to you Hon'ble Sir that how can it be justified to withhold public services arbitrarily and promote anarchy, lawlessness and chaos arbitrarily by making the mockery of law of land? There is need of the hour to take harsh steps against the wrongdoer to win the confidence of citizenry and strengthen the democratic values for healthy and prosperous democracy.
