* Description of Information Sought The matter concerns with the atrocity perpetrated by musclemen on the widow Sugun Singh W/O Krishna Kumar Singh whose husband died last year during the Coronavirus pandemic. Whether it justified to implicate the widow and his sons under section 107/116 of Cr.P.C. by the station officer Vindhyachal Kotwali. There is apprehension of breach of trust to station officer Kotwali Vindhyachal by the followings.1-Sugun Singh W/O Late Krishna Kumar Singh, Age-55 years2-Atul Kumar Singh S/O Late Krishna Kumar Singh age-21 years 3-Nitin Singh S/O Late Krishna Kumar Singh age-19 years For more detail, vide attached document.
PIO in the office of superintendent of police may provide the following information point wise as sought.
1-Copy of the complaints made against Sugun Singh, Atul Kumar Singh and Nitin Singh in Kotwali Vindhyachal in the matter concerned.

* Prayer or Relief Sought Registration Number SPMZR/R/2021/60031 Name Sugun Singh Date of Filing 05/08/2021 Status RTI REQUEST RECEIVED as on 05/08/2021 Detail is attached to the appeal in the PDF form. According to subsection 1 of section 7 of the Right to Information Act 2005-Subject to the proviso to subsection (2) of section 5 or the proviso to subsection (3) of section 6, the Central Public Information Officer or State Public Information Officer, as the case may be, on receipt of a request under section 6 shall, as expeditiously as possible, and in any case within thirty days of the receipt of the request, either provide the information on payment of such fee as may be prescribed or reject the request for any of the reasons specified in sections 8 and 9:It is 17 Sept 2021 today which means 1 month 13 days passed, but PIO did not provide any information which means PIO denied information as quite obvious from the subsection 2 of section 7 of the Right to Information Act 2005 If the Central Public Information Officer or State Public Information Officer, as the case may be, fails to give decision on the request for information within the period specified under subsection (1), the Central Public Information Officer or State Public Information Officer, as the case may be, shall be deemed to have refused the request. Consequently, PIO violated subsection 1 of section 7 of the Right to Information Act 2005.Since the matter concerns with the deep-rooted corruption, therefore public information officer of the public authority office of superintendent of police Mirzapur is only playing the cunning tricks to conceal information so that corrupt staffs of the department of police District Mirzapur may be shielded. Here corrupt staffs of the department of police District Mirzapur not only committed the offence of suppressing the voice of the widow by making the undue pressure on her son but also misused section 107/116 by implicating widow and her sons. Most surprising thing is that muscle men Angad Singh and his son moving freely in the village glorifying his approach which took concerned police staff under pressure. even when criminal offence was committed by him and his goon sons. What kind of signal, concerned police is sending to masses? Circular dated 09 Sept 2021 to curb misuse of section 107/116/151 in the sequence of the directives High court of judicature at Allahabad is the first page of the attached document. Undoubtedly sought information was denied by the public information officer in the office of superintendent of police Mirzapur because supervisory bodies are in good faith of the subordinates quite obvious from the circular issued by the government and worries of the high court regarding misuse of provisions of Cr. P.C. by the police personnel.
