आवेदक का नाम-Nand Lal Singhविषय-Sir, from the report of the concerned investigation officer in the following complaint, it is quite obvious that land grabbers are claiming the 30 years old house of the applicant as his own. Ipso facto 11 months passed and a well-known fact is that police could not proceed against offenders of land grabbing. Section 441,Section 425, Section 420, Section 442 and Section 503 must be invoked against them by the concerned police so that they may not take the law of land in their own hand. As far as brother-in-law is concerned then Article 14 of the Constitution of India provides for equality before the law or equal protection of the laws within the territory of India. It states: "The State shall not deny to any person equality before the law or the equal protection of the laws within the territory of India आवेदनकर्ता का विवरण :शिकायत संख्या:-40019921019966 आवेदक का नाम-Nand Lal Singhविषय-The applicant is Nand Lal Singh S/O Naval Kishore Singh, Village-Babura Post Babura Police station- Kotwali Vindhyachal District Mirzapur PIN Code 231307.The matter concerns the Nand Lal Singh S/O Late Naval Kishor Singh in regard to written representation dated 08/11/2020 submitted before Station House Officer, Police station Marihan on 08/11/2020 regarding threatening tenant Shyam Sundar S/O Jeewan by the Land grabbers named as 1- Vyas ji Mishra S/O Saligram resident of Village-Patevar original resident of Vindhyapuri Colony 2-Suresh Singh S/O Shitala Singh resident of Village-PatevarTappa 84 Tehsil-Marihan District-Mirzapur and others unknown. Aforementioned land grabbers were hurling obscene abuses on the tenant aforementioned. They threatened to kill the tenant and claimed my 30 years old built house as his own. With this online representation, the complaint dated 08/11/2020 as aforementioned attached to this grievance as first two pages of the attached PDF document and last two pages are electricity bills and water bills proving continuation of the applicant in their own built house for 30 years. On the call of the concerned sub inspector, I appeared in person before them three times later they assured to call me but never called me. After 10 months, this inquiry is being made regarding the progress and finding of the concerned police under Article 51 A of the constitution of India. Whether the police has registered the first information report against alleged land grabbers in the matter. If not registered in the First Information Report, then provide the reason for not doing so. Right to reason is an indispensable part of a sound judicial system as well as well-ordered administration; reasons at least sufficient to indicate an application of mind to the matter before court. Another rationale is that the affected party can know why the decision has gone against him. One of the salutary requirements of natural justice is spelling out reasons for the order made If the enquiry cum investigation is still in progress, then they must tell by what time they will complete the investigation and investigation will culminate into a first information report.
