The matter concerns the Director General of Police so may not be forwarded to subordinates to deviate the attention from the real issues which comes under the ambit of D.G.P. office and maintainable by wide public interest. Official mobile number of the applicant is 7379105911.An application under Article 51 A of the constitution of India to make enquiry regarding the misuse of Section 107/116. of the Cr. P.C. on the large scale by the police in the state of Uttar Pradesh instead of adopting logistic approach in transparent and accountable manner. As following is the fundamental duties of every citizen of this country. h- to develop the scientific temper, humanism and the spirit of enquiry and reform j- to strive towards excellence in all spheres of individual and collective activity so that the nation constantly rises to higher levels of endeavour and achievement
Everyone knows that proceedings under Section 107/116. of the Cr. P.C. are only preventive measures and not pure criminal proceedings, but such proceedings are of quasi judicial nature, while the offence of my son is inviting pure criminal proceedings, so my matter is not amenable under section 107/116. Herewith written application addressed to superintendent of police Mirzapur is attached to this representation signed by the aggrieved. D.G.P. office is the monitoring head of department of police in the state of Uttar Pradesh through which state government monitors and ensures the law and order in the state. It is the foremost responsibility of the D.G.P. office to safeguard the rights of people and curb the misuse of provisions of law of land.
1-Whoever seek redressal of their grievances by submitting online applications on the Jansunwai portal of the government of Uttar Pradesh, concerned sub-inspector fabricate them under Section 107/116. of the Cr. P.C in most of the cases. Please provide the measures taken by the D.G.P. office to curb the misuse Section 107/116. of the Cr. P.C. including copy of the circulars issued through the office.2-The job of police is to be instrumental in providing criminal justice, specially to justice seekers and police in the most of the cases lodge F.I.R. under Section 107/116. of the Cr. P.C. which is preventive measure.
Please provide the minutes of proceedings and circulars issued to check the trend of local police who have made illegal practices to misuse the Section 107/116. of the Cr. P.C.in order to provide justice by the D.G.P. office. 3-Police in general to wreak vengeance with the human rights defenders, R.T.I. Activists and social workers whose general aim is to struggle for betterment society slaps charges of breach of peace to suppress their voices. Please provide the circulars issued by the government to curb the misuse of power by the local police under aforementioned circumstances.

Undoubtedly Cr.P.C. 107116 is not privilege of the police because it is subjected to scrutiny by the competent authorities of the government. If someone made allegations regarding the misuse of this tool, then to ensure transparency and accountability, its use by competent offers of the police must be checked. Here report of the sub inspector Bali Maurya is quire relevant that matter must be investigated by the officer nominated by D.G.P. office as it can not be investigated by a Chauki in-charge or circle officer because their purview is limited. They also do not have data and underprivileged to access such data. But one thing is too much unconstitutional that checking of misuse of aforementioned tool by the police still awaiting the heed of accountable public functionaries in the state who are closing the chapter by overlooking this serious issue causing human rights violations of the citizenry on the large scale in the state of Uttar Pradesh.
