Whether to lodge F.I.R. or not is the prerogative of the police if not why did the state police not lodge F.I.R. in the rape matter concerned with Dr. Ram Manohar Lohiya institute?

Whether the serious allegations of rape by the daughter of rape victim may be incredible and Lucknow police escaped to lodge even complaint in the matter? Undoubtedly Yogi Adityanath chief minister of the state talks of good governance in the state and law and order in the state under control while the factual position is that tragic incidence of rape committed by the staffs of Dr. Ram Manohar Lohiya institute in the state capital Lucknow under the nose of Yogi Adityanath and home ministry is under the supervision of Chief Minister Yogi Aditya Nath itself. 

A petition under Article 32 of the constitution of India to seek speedy action in the matter concerned with treatment of the  patients in the state of Uttar Pradesh and curb mismanagement prevailed in the government hospitals.

Prayer-Please pass appropriate order so that serious matters of rape and others committed against vulnerable sections specially women and girls may not be overlooked by the local police because police itself is stumbling block in reaching justice to needy in the state of Uttar Pradesh quite obvious from criticizing comments by Hon'ble justices of the Apex court of India on the number occasions. 

1-I pray before the Honourable Sir that  51A. Fundamental duties It shall be the duty of every citizen of India (a) to abide by the Constitution and respect its ideals and institutions, the National Flag and the National Anthem;(h) to develop the scientific temper, humanism and the spirit of inquiry and reform;

(i) to safeguard public property and to abjure violence;

(j) to strive towards excellence in all spheres of individual and collective activity so that the nation constantly rises to higher levels of endeavour and achievement.

2-I pray before the Honourable Sir that whether action will be taken in the serious allegations of criminal matters after the direction of senior political masters in the state of Uttar Pradesh ipso facto and if such politicians show the reluctant approach in the matter, then justice is like a wild goose chase for victim. In other words justice has been sacrificed or crushed by  the corruption i the state of Uttar Pradesh. 

3-I pray before the Honourable Sir that following is the detail of news item published in the leading Hindi daily Amar Ujala in which police categorically denied taking action on the representation of the rape victim in the state capital Lucknow quite obvious from widely circulated news through print and electronic media.

अमेठी पहुंची केंद्रीय मंत्री स्मृति ईरानी को एक युवती ने अपनी मां के साथ दुष्कर्म होने की बात बताई। युवती ने बताया कि इलाज के दौरान उसकी मां का दुष्कर्म किया गया। केंद्रीय मंत्री ने मामले को गंभीरता से लेते हुए अफसरों को निर्देश दिए हैं।

मेडिकल स्टाफ की हैवानियत का एक बड़ा मामला प्रकाश में आया है। शहर के एक वार्ड निवासी युवती ने अपनी 40 वर्षीय मां के साथ लखनऊ के डॉ. राम मनोहर लोहिया इंस्टीटयूट के स्टाफ पर दुष्कर्म करने का आरोप लगाया है। पुलिस द्वारा फरियाद न सुने जाने पर उसने रो-रोकर अपनी व्यथा अमेठी जिले के दौरे पर आईं केंन्द्रीय वस्त्र एवं महिला तथा बाल कल्याण मंत्री स्मृति ईरानी को सुनाई। स्मृति के निर्देश पर डीएम ने जांच टीम गठित कर रिपोर्ट तलब की है।

शहर के एक वार्ड निवासी महिला को पिछली छह तारीख को तबीयत खराब होने पर संयुक्त जिला अस्पताल गौरीगंज में भर्ती कराया गया था। महिला की पुत्री ने बताया कि हालत गंभीर होने पर चिकित्सकों ने उसकी मां को डॉ. राम मनोहर लोहिया इंस्टीटयूट रेफर कर दिया।

पुत्री का आरोप है कि वहां सात तारीख को उसकी मां को पहले इमरजेंसी व बाद में चौथी मंजिल के बेड संख्या 41 पर भर्ती कर दिया गया। इसके बाद परिजनों को बाहर भेज दिया गया। किसी को मिलने नहीं दिया गया। बहुत निवेदन करने पर जब दो दिन बाद वह अपनी मां से मिली तो उसकी हालत नाजुक थी। मिलने पर उसकी मां ने चिकित्सकों व स्टाफ द्वारा उसे मारने-पीटने तथा कुछ गलत किए जाने की बात कही।

इसके बाद बेहोशी की हालत में शुक्रवार रात वहां से डिस्चार्ज कराकर फिर से जिला अस्पताल गौरीगंज में भर्ती कराया गया। शनिवार को अचानक जिला मुख्यालय पहुंचीं केंद्रीय मंत्री स्मृति ईरानी से युवती ने कहा कि मां को भर्ती कराने के बाद जब परिजन सुबह केस दर्ज कराने स्थानीय थाने पहुंचे तो पुलिस ने टरका दिया। युवती की बात सुनने के बाद स्मृति ने डीएम, एसपी व सीएमओ से वार्ता कर मामले में कार्रवाई सुनिश्चित करने का निर्देश दिया।

There is need of the hour to take harsh steps against the wrongdoer to win the confidence of citizenry and strengthen the democratic values for healthy and prosperous democracy.
