State Public Information Concerned made available aforementioned sought information online today i.e. 22/04/2021 as follows.
Under each point, you provided information as follows.
Applicant cum victim Ashutosh Singh lodged F.I.R. on 13/03/2021 registered by police as Litigation number-124/2021 under section 307 of Indian Penal Code. Police are carrying out investigations and collecting evidence.
Right to Information Act 2005 was brought up by the government of India to promote transparency and accountability in the working of the public authority. Under the first point it is categorically mentioned Krishna Nagar police station as well as in the Sarojini Nagar police station. Here your misleading report is only concerned with Krishna Nagar Police station not Sarojini Nagar police station which means the provided information is incomplete.
Applicant itself identified an offender in police station Krishna Nagar out of four suspects but it seems police left him arbitrarily by taking bribes otherwise why not provided the detail of that offener under pont 2.
Under point 3 they did not take any action in regard to Jaguar car used by culprits while the registration detail is available to them quite obviously from the F.I.R. Police did not provide any information as sought by the information seeker because it is more interested in shielding the criminal elements because of the corruption.

Whether it is not mockery of Right to Information Act that concerned police concealed information as it was hatching conspiracy the protect the offenders by diluting the Section 307 of Indian Penal code into 323 of IPC.

Think about the gravity of situation that information was made available after the first appeal.
ReplyDeleteAND WHEREAS democracy requires an informed citizenry and transparency of information which are vital to its functioning and also to contain corruption and to hold Governments and their instrumentalities accountable to the governed;
Undoubtedly police has played a negative role in the matter it has decreased the quantum of the punishment through section 323 of the Indian penal code imposed through the cryptic proceedings and the criminal elements on whom first information report was lodged under section 307 now substituted by section 323 of the Indian penal code while under section 323 which is less effective on the criminal elements because its quantum of punishment is less in comparison to section 307 it is well known fact.
ReplyDeleteHow can it be justified that first information report lodged under section 307 of Indian penal code was changed into section 323 of the Indian penal code by the concerned investigation officer of the police department quite obvious from the post. It is well accepted that initially police does not lodge first information report according as quantum of the offence committed by the criminal elements and now they have decreased section which means that they have colluded with the criminal elements.
