* Prayer or Relief Sought Whether a public information officer in the office of police commissioner Lucknow is a layman not apprised with the provisions of Right to Information Act 2005? Right to Information Act 2005 has been introduced by the government of India to promote transparency and accountability in the working of the public authorities so that corruption in the public offices which is rampant in this largest democracy in the world may be reduced. Your appellant sought information under four points and incompetent public information officer cryptically denied the information on the flimsy round that action has uploaded in the grievance such and such. Everyone knows that there is circumstantial evidence that concerned police staffs have nexus with the criminal elements and committing crime through such goons and submitting arbitrary reports on the Jansunwai and CPGRAM portals of the government. Here the public information officer must know how the transparency and accountability will be ensured if information will be denied by him under R,T,I, Act 2005 in this cryptic manner by taking the recourse of such websites where there is no transparency and accountability and I can prove it through my representative through proper evidence if the government may order an inquiry against the concerned police.According to provision of Right to Information Act 2005, whatever information is available under any law for time being in force, same information is available under the provisions of Right to Information Act 2005. Right to Information Act 2005 is a special act which controversies are subject to the jurisdiction of the transparency ombudsman central information commission in the matters of central governments and state information commission in the case of states. How will the transparency ombudsmann ensure that PIO has provided information if matter will be brought up before it under subsection 3 of section 19 of the Right to Information Act 2005? Here information is not available as sought by the appellant from the public information officer in the office of police commissioner Lucknow.

श्री मान जी  विवेचक महोदय की आख्या चौंकाने वाली है श्रीमान जी जहां विवेचक महोदय धक्का मुक्की की बात कर रहे है  वही पर यदि आप संलग्न मेडिकल रिपोर्ट और प्रार्थी के बहते खून और आखो की स्वेलिंग देखे तो आप को खुद महसूस हो जाएगा की सम्बंधित पुलिस की विश्वसनीयता क्या है इसलिए यह स्पस्ट है की    शिकायत संख्या:-40015721023892 आवेदक का नाम-Ashutosh Singh का निस्तारण गुण  दोष के आधार पर नहीं हुआ है बल्कि विवेचक द्वारा बिना विषयवस्तु का परिशीलन किये मनमाने तरीके से किया गया है और ऐसा निस्तारण अपराधियों को लाभ पहुंचाने के उद्देश्य से किया गया है महोदय जब सीधे प्रमाण है और पुलिस इन प्रमाणों की अनदेखी कर रही है और प्रत्यावेदन प्रस्तुत करने में प्रार्थी द्वारा कोई कोताही नहीं की गयी तो सोचिये सामान्य आदमी को क्या इस आराजकता  में न्याय मिल सकता है श्री मान जी तीसरे और चौथे आपराधिक खड्यंत्र को जो की प्रार्थी को जान से मारने का प्रयास किया गया सरोजनी नगर पुलिस क्यों नजर अंदाज कर रही है इससे तो यही प्रतीत होता है की तीसरा और चौथा हमला पुलिस को विश्वास में ले कर किया गया श्री मान जी पुलिस को लिखित तहरीर दिया गया किन्तु सरोजनी नगरपुलिस द्वारा अभी तक प्रथम सूचना रिपोर्ट तक दर्ज नहीं किया गया है श्रीमान जी क्या वे १५ अपराधी असलहो से लैस हो कर प्रार्थी को मारने पुलिस के सह से आये थे यदि नहीं पुलिस प्रथम सूचना रिपोर्ट दर्ज करने में टालमटोल क्यों कर रही है यह भी हो सकता है की पुलिस खुद ही अपराधियों से भयाक्रांत हो अन्यथा कार्यवाही करने में कोताही क्यों

विषय-श्री मान जी अपराधियों को भारतीय दंड विधान की धारा  ३०७ में निरुद्ध किया जानासमीचीन होगाक्योकि उनका हौसला बढ़ा हुआ है और वे लोग प्रार्थी पर दो बार जान लेवाहमला कर चुके है आज तीसरी बार शाम पांच बजे १५ अराजक तत्व लाठीडंडे और राड से लैस होकर जिनके पास अत्याधुनिक असलहे भी थे प्राथी  के आवास applicant Ashutosh SinghS/O Mr Narendra Pratap Singh APC State II A  Literacy House Kanpur Road Lucknow पर धावाबोले जो प्रदेश की राजधानी में कानून की बिगड़ती दशा का द्योतक है यह महत्वपूर्ण है की क्या उन १५ दहसत गर्दो में प्रदेश की कानून ब्यवस्था का भय है क्यासम्बन्धित पुलिस अधिकारी तीसरा प्रथम सूचना रिपोर्ट दर्जकरेंगे या अपराधियों बढे हुए मनोबल को परदेके पीछे से संजीवनी देंगे श्री मान जी पुलिस के समक्ष जान से मारने की धमकीदेना ही पुलिस की असलीपोल खोल रहा है क्याइन पंद्रह दहसत गर्दो को पुलिस का आशीर्वाद प्राप्त जो खुले आम एक शहरी को बार बार जान से मारने का प्रयास कर रहे है क्या सम्बंधित पुलिस कोई कार्यवाही की या सिर्फ मामले का तमाशबीन बन के रह जाएगी योगी आदित्यनाथ की कुर्सी के नीचेयह क्यातमाशा हो  रहा कानून व्यवस्था का नंगा नाच फिर भी कानून व्यवस्था चुस्त दुरुस्त अर्थात सच से कोसो दूर श्री मान जी १५ लोगो के विरुद्ध प्रथम सूचना रिपोर्ट दर्जकरके बलवा का मुक़दमा कायम कियाजाय और प्रार्थी को सुरक्षा प्रदान की जाए अन्यथा प्रार्थी की मृत्यु के लिए प्रशासन जिम्मेदार होगाक्यों की वरिष्ठ अधिकारिओं के संज्ञान में है मामला फिर भी निचला स्तर  खड्यंत्र करने से बाज नहीं आ रहा है प्रार्थी को पुलिस की सुरक्षा प्रदान की जाए
